The minimum rights prescribed by this Article also encompass the right of the accused to be tried in his presence and to defend himself in person or by legal assistance of his/her own choosing and to have legal assistance assigned to him/her, in any case where the interests of justice so require, and without payment by him/her in any such case if he/she does not have sufficient means to pay for it.

3.10 The author states that the facts summarised in paragraph 2.24 above demonstrate that there was a separate violation of article 14, paragraphs 3(b) and (d), read in conjunction with article 14, paragraph 1, and article 2, paragraph 3(c), of the Covenant, since he was not allowed to take part in the cassation proceedings and could not, therefore defend himself in person.
