The State party submits that the author has failed to substantiate, for purposes of admissibility, his claims under articles 17 and 23.

Consequently, the Committee considers that the author has not sufficiently substantiated his claims under article 12 for the purposes of admissibility, and finds that this part of the communication is inadmissible under article 2 of the Optional Protocol.

5.10 The author reiterates his claims under article 10 of the Covenant regarding inhuman conditions of detention and ill-treatment that, in his opinion, are uncontested by the State party.
5-10 ويكرر صاحب البلاغ ادعاءاته في إطار المادة 10 من العهد فيما يتعلق بظروف الاحتجاز اللاإنسانية وسوء المعاملة، التي يرى أن الدولة الطرف لا تعترض عليها.

The Committee considered that the author had sufficiently substantiated his claims under article 14, read together with article 26 of the Covenant for purposes of admissibility.
ورأت اللجنة أن صاحب البلاغ قد قدّم ما يكفي من الإثباتات لدعم ادعاءاته بموجب المادة 14، مقترنة بالمادة 26 من العهد لأغراض المقبولية.

The author concludes that the reservation is invalid and does not preclude the Committee from examining his claims under article 26.

The Committee considered that the author had not substantiated, for purposes of admissibility, his claim under articles 7 and 17 of the Covenant, and that his claims under articles 9 and 13 of the Covenant were incompatible with these provisions.

The Committee notes that the State party has not provided any explanation as to the remedies available to the author, in particular, regarding his claims under article 25 of the Covenant.
وتلاحظ اللجنة أن الدولة الطرف لم تقدم أي توضيح بشأن سبل الانتصاف المتاحة محلياً لصاحب البلاغ لا سيما فيما يتعلق بادعاءاته بموجب المادة 25 من العهد.

Accordingly, the Committee considers that the author has failed to substantiate his claims under these articles for purposes of admissibility, and that they are inadmissible under article 2 of the Optional Protocol.
وبناء عليه، ترى اللجنة أن صاحب البلاغ لم يدعم ادعاءاته في إطار هذه المواد لأغراض المقبولية، وأن هذه الادعاءات غير مقبولة بموجب المادة ٢ من البروتوكول الاختياري.

4.5 The State party submits that the author has not substantiated his claims under articles 6 and 7.
4-5 وتعتبر الدولة الطرف أن صاحب البلاغ لم يقدم أدلة تدعم ادعاءاته في إطار المادتين 6 و7.

The State party concludes that his claims under article 14, read alone and in conjunction with articles 2 and 26, of the Covenant are inadmissible ratione materiae.
وتخلص الدولة الطرف إلى أن ادعاءات صاحب البلاغ بموجب المادة 14، مقروءة بمفردها وبالاقتران مع المادتين 2 و26 من العهد، غير مقبولة من حيث الاختصاص المادي.

4.9 In light of the above considerations, the State party maintains that the complainant's allegations that he was subjected to ill-treatment by the CDIA police officers and his claims under articles 1; 12; 13; 14; 15 and 16 of the Convention are manifestly ill-founded and inadmissible.
4-9 وفي ضوء هذه الحيثيات، تدفعّ الدولة الطرف بأن ادعاءات صاحب الشكوى المتعلقة بتعرّضه لسوء معاملة على أيدي ضباط الشرطة في الدائرة الجنائية لإدارة الشؤون الداخلية لمدينة رودني وبأن تظلماته المقدَّمة بموجب المواد 1 و12 و13 و14 و15 و16 من الاتفاقية تفتقر بكل وضوح إلى أسس سليمة ولا يمكن قبولها.

8.4 As to his claims under article 14, paragraph 3 (a), of the Covenant, the author complains that the State party simply quotes the summons, which states that " Mr. O. collected unemployment benefit while engaged in undeclared gainful employment from 28 February 1996 to 31 October 1997. "
8-4 وفيما يتعلق بالادعاءات بموجب الفقرة الفرعية 3(أ) من المادة 14، يعيب صاحب البلاغ على الدولة الطرف اكتفاءها بتكرار ما ورد في التكليف بحضور المتهم: " حصل السيد أوين على إعانات بطالة دون التصريح بنشاط مأجور من 28/2/1996 إلى 31/10/1997 " .

It therefore concluded that the author had sufficiently substantiated, for purposes of admissibility, his claims under article 5 (a) and (e) (i), read together with article 1, paragraph 1, of the Convention.
ولذلك فقد خلصت اللجنة إلى استنتاج مفاده أن صاحب البلاغ قدم من الأدلة ما يكفي، لأغراض قبول البلاغ، لإثبات مزاعمه بمقتضى المادة 5(أ) و(ه) ' 1 ' ، مقترنة بالفقرة 1 من المادة 1 من الاتفاقية.

6.3 The Committee considers that the author has sufficiently substantiated, for purposes of admissibility, his claims under article 9, paragraph 1, and article 14, paragraph 5, of the Covenant, and therefore proceeds to their examination on the merits.
6-3 وترى اللجنة أن صاحب البلاغ قدم، لأغراض المقبولية، أدلة كافية على ادعاءاته التي تثير قضايا في إطار الفقرة 1 من المادة 9، والفقرة 5 من المادة 14 من العهد، وبناءً على ذلك تشرع في النظر في الأسس الموضوعية.

In addition, by annulling his appeal, the author acknowledges that the Court of Cassation addressed his claims under article 14, concerning the criminal proceedings before the Central Criminal Court of Iraqi.
ثم إن صاحب البلاغ يعترف بأن محكمة التمييز، بإلغاء قرار إدانته، قد تناولت ادعاءاته المقدمة في إطار المادة 14، المتعلقة بالدعوى الجنائية المرفوعة ضده أمام المحكمة الجنائية المركزية العراقية.

10.3 The Committee considers that the author has sufficiently substantiated his claims under articles 7, 17 and 23, paragraph 1, for purposes of admissibility.
