Article 40, paragraph 3, of the Convention on the Rights of the Child, as well as rule 11.1 of the Beijing Rules, require States to establish measures for dealing with children without resorting to formal judicial proceedings, whenever appropriate and desirable, while ensuring that human rights and legal safeguards are fully respected.
9- تنص الفقرة 3 من المادة 40 من اتفاقية حقوق الطفل والقاعدة 11-1 من قواعد بكين على أن تعتمد الدول تدابير للتعامل مع الأطفال دون اللجوء إلى الإجراءات القضائية الرسمية، حيثما كان ذلك مناسباً ومستصوباً، شريطة احترام حقوق الإنسان والضمانات القانونية احتراماً كاملاً.

A higher MACR, for instance 14 or 16 years of age, contributes to a juvenile justice system which, in accordance with article 40 (3) (b) of CRC, deals with children in conflict with the law without resorting to judicial proceedings, providing that the child's human rights and legal safeguards are fully respected.
