In particular, the State party is requested to complete the investigations into the threats and the ill-treatment to which Mr. Hylton has been subjected and to punish those held to be responsible for his treatment.

However, she denies that Mr. Hylton's communication raises issues of res judicata or that it falls within the ambit of article 3 of the Protocol for any other reason.

Having concluded its consideration of communication No. 600/1994, submitted to the Human Rights Committee on behalf of Mr. Dwayne Hylton under the Optional Protocol to the International Covenant on Civil and Political Rights,

2.1 Dwayne Hylton was convicted of murder and sentenced to death on 26 May 1988 by the Circuit Court in Manchester, Mandeville, Jamaica.
٢-١ أدين دوين هيلتون بجريمة القتل العمد وحكم عليه باﻹعدام في ٢٦ أيار/ مايو ١٩٨٨ في محكمة دائرة مانتشستر في ماندِفيل بجامايكا.

3.1 It is submitted that Mr. Hylton is a victim of a violation of articles 7 and 10 of the Covenant, in view of the length of time spent on death row.
٣-١ تدعي المحامية بأن السيد هيلتون هو ضحية لﻹخلال بأحكام المادتين ٧ و ١٠ من العهد، نظرا لطول الفترة التي قضاها بانتظار تنفيذ حكم اﻹعدام فيه.

6.4 In the instant case, Mr. Hylton formulates a claim related to the so-called " death row phenomenon " .
٦-٤ في القضية الراهنة، يقدم السيد هيلتون ادعاء متصلا بما يسمى " ظاهرة الاحتجاز انتظارا لتنفيذ حكم اﻹعدام " .

The way in which the majority opinion on the communication submitted by Mr. Dwayne Hylton against Jamaica has been expressed obliges me to express my individual opinion.

It reiterates that domestic remedies within the meaning of the Optional Protocol must be both available and effective, and that in the absence of effective legal aid made available by the State party for the purpose, a constitutional motion is not a remedy available to Mr. Hylton.
وهي تؤكد أن سبل الانتصاف المحلية بالمعني الذي يقصده البروتوكول الاختياري يجب أن تكون متاحة وفعالة وأنه إذا لم توفر الدولة الطرف المساعدة القانونية الفعالة لهذا الغرض لا تكون الدعوة الدستورية سبيلا متاحا للسيد هيلتون.

11.1 In accordance with the provisions of article 2 of the Covenant, the State party is under an obligation to take effective measures to remedy the violations suffered by Mr. Hylton, including the award of appropriate compensation, and to ensure that similar violations do not occur in the future.
١١-١ ووفقا ﻷحكام المادة ٢ من العهد، فإن، الدولة الطرف ملزمة باتخاذ تدابير انتصاف للانتهاكات التي تعرض لها السيد هيلتون بما في ذلك منحه التعويض الملائم وضمان ألا تحدث انتهاكات مماثلة في المستقبل.

A prior communication submitted by Mr. Hylton was examined by the Human Rights Committee in case No. 407/1990;a in respect of that communication, the Committee adopted views on 8 July 1994 and found violations of articles 7 and 10 of the Covenant.
وقامت اللجنة المعنية بحقوق اﻹنسان، في إطار القضية رقم ٤٠٧/١٩٩٠)أ(، بدراسة بلاغ كان السيد هيلتون قد قدمه سابقا. وفي ٨ تموز/يوليه ١٩٩٤، اعتمدت اللجنة آراءها بشــأن ذلك البلاغ، وذكرت فيها أنه قد تبين لها حدوث انتهاكات للمادتين ٧ و ١٠ من العهد.
