PRELIMINARY COMMENTS ON ARTICLE I of the Convention

" Hostile use " is a clear allusion to Article I of the Convention and covers both State and non-State actors.

The Conference welcomes statements made by States Parties that they do not possess agents, toxins, weapons, equipment or means of delivery prohibited by Article I of the Convention.
5- ويرحب المؤتمر بالبيانات الصادرة عن الدول التي أصبحت أطرافاً في الاتفاقية بأنها لا تمتلك عوامل أو تكسينات أو أسلحة أو معدات أو وسائل إيصال مما هو محظور في المادة الأولى من الاتفاقية.

6. The Fourth Review Conference affirmed that the use by States Parties, in any way and under any circumstances, of microbial or other biological agents or toxins, that is not consistent with prophylactic, protective or other peaceful purposes, is effectively a violation of Article I of the Convention. [IV.I.3]
6- وأكد المؤتمر الاستعراضي الرابع أن استعمال الدول الأطراف للعوامل الجرثومية أو العوامل البيولوجية الأخرى أو التكسينات بأي وسيلة وتحت أي ظروف، على نحو لا يتسق مع أغراض الوقاية أو الحماية أو غيرها من الأغراض السلمية هو فعلياً انتهاك للمادة الأولى من الاتفاقية. [IV.I.3]

They also reaffirmed that the use by the States Parties, in any way and under any circumstances, of microbial or other biological agents or toxins, that is not consistent with prophylactic, protective or other peaceful purposes, is effectively a violation of Article I of the Convention.

Article 1 Obligation of a State to secure to everyone within its jurisdiction the rights and freedoms defined in section I of the Convention, inter alia:

The secretariat examines notifications of final regulatory action submitted under article 5 of the Convention to determine whether they include the information required under Annex I of the Convention.
32 - تبحث الأمانة إخطارات الإجراء التنظيمي النهائي المقدمة طبقاً للمادة 5 من الاتفاقية لتحديد ما إذا كانت تشمل المعلومات المطلوبة بموجب المرفق الأول من الاتفاقية.

Paragraph 4 of the same article obliges the Secretariat to circulate a synopsis of all the notifications of final regulatory action that it has received, including information regarding those notifications that do not contain all the information listed in Annex I of the Convention.
وتلزم الفقرة 4 من نفس المادة الأمانة بتعميم ملخص بجميع ما تتلقاها من الإخطارات بالإجراء التنظيمي النهائي، بما في ذلك المعلومات المتعلقة بالإخطارات التي لا تشتمل على جميع المعلومات المطلوبة في المرفق الأول بالاتفاقية.

242. Annex A shall list only those Parties to the instrument currently listed in Annex I of the Convention.

Moreover, Article IV requests States Parties to take the " necessary measures to prohibit and prevent the development, production, stockpiling, acquisition or retention of the agents, toxins, weapons, equipment and means of delivery specified in Article I of the Convention, within the territory of such State, under its jurisdiction or under its control anywhere " .

Decides to set up a nationally appropriate mitigation action crediting mechanism under the Kyoto Protocol, in which credits for the verifiable nationally appropriate mitigation actions of the developing country Parties not included in Annex I of the Convention can be issued in order to assist such Parties in achieving sustainable development and contributing to global efforts to combat climate change;
13- يُقرر إنشاء آلية لتسجيل الأرصدة الدائنة لإجراءات التخفيف المناسبة وطنياً بموجب بروتوكول كيوتو، يمكن في إطارها اعتماد أرصدة دائنة لصالح البلدان النامية الأطراف غير المُدرجة في المرفق الأول للاتفاقية مقابل إجراءات التخفيف المناسبة وطنياً التي تتخذها ويمكن التحقق منها، وذلك بغية مساعدتها في تحقيق التنمية المستدامة والمساهمة في الجهود المبذولة عالمياً لمكافحة تغير المناخ؛

With regard to scheduling in Schedule I of the 1971 Convention, Latvia indicated that it would have significant consequences in veterinary practice and therefore did not agree with adding the substance to Schedule I of the Convention.
