بيان قمة الدوحة بشأن التضامن مع جمهورية السودان في رفض قرار الدائرة التمهيدية الأولى للمحكمة الجنائية الدولية في حق فخامة الرئيس عمر حسن أحمد البشير رئيس جمهورية السودان

On 24 July 2006, Pre-Trial Chamber I of the International Criminal Court invited me to submit in writing my observations " on issues concerning the protection of victims and the preservation of evidence in Darfur, Sudan " .
وفي 24 تموز/يوليه 2006، دعتني الدائرة الابتدائية الأولى للمحكمة الجنائية الدولية إلى تقديم ملاحظات خطية بشأن القضايا المتعلقة بحماية الضحايا وحفظ الأدلة في دارفور، بالسودان.

Cautioning that the decision of Pre-Trial Chamber I of the International Criminal Court will, under the cloak of international justice, undermine the principle of the sovereignty of States and damage the current peace process in the Sudan,

11. To commend the steadfastness of the Sudanese people and the tenacity of its internal front in opposing the decision of Pre-Trial Chamber I of the International Criminal Court;
11 - الإشادة بصمود الشعب السوداني وتماسك جبهته الداخلية في مواجهة قرار الدائرة التمهيدية الأولى للمحكمة الجنائية الدولية.

61. On 10 February 2006, Pre-Trial Chamber I of the International Criminal Court issued a warrant of arrest against Thomas Lubanga Dyilo of the Democratic Republic of the Congo, who is the leader and founder of the Union des patriotes congolais.

12. On 3 June, Pre-Trial Chamber I of the International Criminal Court decided to adjourn the hearing on the confirmation of charges against former President Gbagbo, currently detained in The Hague, and requested the Prosecutor to consider providing further evidence with respect to the charges.
12 - وفي 3 حزيران/يونيه، قررت الدائرة التمهيدية الأولى للمحكمة الجنائية الدولية أن ترجئ جلسة الاستماع الخاصة بإقرار التهم ضد الرئيس السابق غباغبو، المحتجز حاليا في لاهاي، وطلبت إلى المدعية العامة النظر في تقديم المزيد من الأدلة فيما يتعلق بالتهم.

To consider the decision of Pre-Trial Chamber I of the International Criminal Court concerning President Umar Hassan Ahmad al-Bashir as a serious precedent, targeting a head of State who continues to perform the duties of his position, and a violation of the Vienna Convention on Diplomatic Relations (1961) and the tenets of international customary law, and to reject that decision together with all effects arising therefrom;

To call for the measures taken by Pre-Trial Chamber I of the International Criminal Court to be overturned, particularly as the Sudan is not a member of this court, and to call upon the Security Council to assume its responsibilities to establish peace and stability in the Sudan;

The Peace and Security Council of the African Union (AU), at its 175th meeting held on 5 March 2009, adopted the following decision on the ruling of PreTrial Chamber I of the International Criminal Court (ICC) to issue an arrest warrant against the President of the Republic of the Sudan, Mr. Omar Hassan Al Bashir:
اعتمد مجلس السلام والأمن التابع للاتحاد الأفريقي في جلسته 175، المعقودة في 5 آذار/مارس 2009، المقرر التالي بشأن قرار الدائرة الابتدائية الأولى للمحكمة الجنائية الدولية إصدار مذكرة توقيف ضد رئيس جمهورية السودان، السيد عمر حسن البشير:

58. The situation during the reporting period was dominated by the decision on 4 March, of the Pre-Trial Chamber I of the International Criminal Court to issue a warrant for the arrest of Omar Hassan Ahmad al-Bashir, President of the Sudan, for two counts of war crimes and five counts of crimes against humanity.
58 - أثناء الفترة المشمولة بالتقرير، طغى على الحالة السائدة القرارُ الصادر في 4 آذار/مارس عن الدائرة التمهيدية الأولى للمحكمة الجنائية الدولية بإصدار مذكرة لتوقيف عمر حسن أحمد البشير، رئيس جمهورية السودان، بتهمة تورّطه في جريمتي حرب وخمس جرائم ضد الإنسانية.

87. 4. To consider the decision of Pre-Trial Chamber I of the International Criminal Court concerning President Omar Hassan Ahmad al-Bashir as a serious precedent targeted at a State President who continues to perform the functions of his position and as a violation of the Vienna Convention on Diplomatic Relations of 1961 and of the principles of international customary law, and to reject that decision and all effects arising out of it;
4 - اعتبار قرار الدائرة التمهيدية الأولى للمحكمة الجنائية الدولية بحق فخامة الرئيس عمر حسن أحمد البشير، سابقة خطيرة تستهدف رئيس دولة ما يزال يمارس مهام منصبه، ويُعد خرقاً لاتفاقية فيينا للعلاقات الدبلوماسية لسنة 1961، ولقواعد القانون الدولي العرفي، ورفضه مع كل ما يترتب عليه من آثار.

5. To call for invalidation of the measures adopted by Pre-Trial Chamber I of the International Criminal Court, particularly since the Sudan is not a member of this Court, and to call on the Security Council to assume its responsibilities in establishing peace and stability in the Sudan;
5 - المطالبة بإلغاء الإجراءات المتخذة من قِبَل الدائرة التمهيدية الأولى للمحكمة الجنائية الدولية خاصةً وأن السودان ليس عضواً في هذه المحكمة، ودعوة مجلس الأمن إلى تحمل مسؤولياته في إقرار السلام والاستقرار في السودان.

Pre-Trial Chamber I of the International Criminal Court concluded that there are reasonable grounds for believing that three Libyan officials are criminally responsible for indirectly committing crimes against humanity (murder and persecution).
وانتهت الدائرة التمهيدية الأولى للمحكمة الجنائية الدولية إلىا أن هناك أسبابا معقولة تدعو لإلى الاعتقاد بأن ثلاثة من كبار الموظفين الليبيين مسؤولوين جنائياً عن ارتكاب جرائم ضد الإنسانية بصورة غير مباشرة (القتل والاضطهاد).

OHCHR developed practices in this area and as a recognition of its efforts, it was invited by Pre-Trial Chamber I of the International Criminal Court on 24 July 2006 to submit observations on issues concerning the protection of victims, witnesses and the preservation of evidence.

In a landmark decision, Preliminary Chamber I of the International Criminal Court extensively cited the Kunarac judgement to interpret article 7 (1) (The Prosecutor v. Ahmad Muhammad Harun ( " Ahmad Harun " ) and Ali Muhammad Ali Abd-Al-Rahman ( " Ali Kushayb " ), No. ICC-02/05-01/07, Decision on the Prosecutor application under article 58 (7) of the Statute, 27 April 2007, paras. 60 - 62).
