وفي هذا الصدد، تسترعي اللجنة أيضاً اهتمام الدولة الطرف إلى توصيتيها العامتين السابعة والخامسة عشرة بشأن توافق الحظر المفروض على نشر الأفكار القائمة على التفوق العرقي أو الكراهية، مع الحق في حرية الرأي والتعبير.

The Committee recalled that article 4 of the Convention requires States parties to penalize four categories of misconduct: (i) dissemination of ideas based upon racial superiority or hatred; (ii) incitement to racial hatred; (iii) acts of violence against any race or group of persons of another colour or ethnic origin; and (iv) incitement to such acts.
وذكَّرت اللجنة بأن المادة 4 من الاتفاقية تطالب الدول الأطراف بتجريم أربع فئات من فئات سوء السلوك هي: `1` بث الأفكار القائمة على التفوق العرقي أو الكراهية؛ `2` التحريض على الكراهية العرقية؛ `3` أعمال العنف ضد أي عرق أو أية جماعة من الأشخاص من لون أو أصـل إثني آخر؛ `4` التحريض على مثل هذه الأعمال.

4- ورأي اللجنة أن حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير.

The Committee also clearly stated that in its opinion, " the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression " .
وذكرت اللجنة بوضوح أيضاً أنها ترى أن " حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير " (7).

13. Reaffirms that general comment No. 15 of the Committee on the Elimination of Racial Discrimination, in which the Committee stipulates that the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the freedom of opinion and expression, is equally applicable to the question of incitement to religious hatred;
13- يعيد التأكيد على أن التعليق العام رقم 15 الصادر عن لجنة القضاء على التمييز العنصري، الذي جاء فيه أن حظر نشر كافة الأفكار القائمة على أساس التفوق العنصري أو الكراهية العنصرية يتمشى مع حرية الرأي والتعبير وهو حظر ينطبق بالمثل على مسألة التحريض على الكراهية الدينية؛

53. With regard to the interpretation of article 4 of the Convention, the Special Rapporteur refers to Recommendation XV of the Committee on the Elimination of Racial Prejudice, in which the Committee expresses the opinion that " the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.

CERD was fully aware of the related problems and stressed in general recommendation No. 15 that " the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression. "
وكانت اللجنة واعية تمام الوعي بالصعوبات المتصلة بالتنفيذ، فشدّدت في توصيتها العامة رقم 15 على أن " حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير " .
