3- إذا سبق لدولتين أو أكثر من الدول الأطراف أن أبرمت اتفاقا أو ترتيبا بشأن موضوع تتناولـه هذه الاتفاقية أو أرسـت علاقاتها على أي نحو آخر فيما يتعلق بذلك الموضوع، حق لها أن تطبق ذلك الاتفاق أو الترتيب بدلا من هذه الاتفاقية، اذا كان ييسر التعاون الدولي.

3- إذا سبق لدولتين أو أكثر من الدول الأطراف أن أبرمت اتفاقا أو ترتيبا بشأن موضوع تتناولـه هذه الاتفاقية أو أرست علاقاتها على أي نحو آخر فيما يتعلق بذلك الموضوع، حق لها أن تطبق ذلك الاتفاق أو الترتيب بدلا من هذه الاتفاقية طالما كان يعزز فعالية أحكامها.
