V. RELATIONSHIP BETWEEN THE illicit dumping OF TOXIC
خامسا - العلاقة بين اﻹلقاء غير المشروع للمنتجات والنفايات

The Special Rapporteur therefore recalls the commitment made by all States “to adopt and vigorously implement existing conventions relating to the dumping of toxic and dangerous products and waste and to cooperate in the prevention of illicit dumping”.
وبناء عليه تذكّر المقررة الخاصة بتعهد كافة الدول " باعتماد الاتفاقيات القائمة المتعلقة بإلقاء المواد والنفايات السامة أو الخطرة وبتنفيذها وبالتعاون على منع الالقاء غير المشروع " .

The Government of Nigeria made the following suggestions to control and eliminate the illicit dumping of toxic wastes:
وقدمت حكومة نيجيريا الاقتراحات التالية لمراقبة القاء النفايات السمية بشكل غير مشروع والقضاء عليه:

Domestic compensation funds should be established along with independent national commissions of inquiry endowed with judicial or quasi-judicial powers in alleged cases of illicit transfer or attempted illicit dumping.
ويجب إنشاء صناديق تعويض وطنية ولجان تحقيق وطنية مستقلة ومخولة سلطات قضائية أو شبه قضائية للبت في قضايا نقل النفايات أو محاولات التخلص غير المشروع المزعومة.

V. RELATIONSHIP BETWEEN THE illicit dumping OF TOXIC AND
خامساً - العلاقة بين اﻹلقاء غير المشروع للمنتجات والنفايات

92. It should be recalled that, in the Vienna Declaration and Programme of Action, the international community recognized that “illicit dumping of toxic and dangerous substances and waste potentially constitutes a serious threat to the human rights to life and health of everyone”.
٢٩- لا بد من التذكير بأن المجتمع الدولي سلّم في إعلان وبرنامج عمل فيينا بأن اﻹلقاء غير المشروع للمواد والنفايات السمية والضارة قد يشكل تهديداً خطيراً لحق كل إنسان في الحياة وفي الصحة.

116. In its resolution 1995/81, the Commission requested the Special Rapporteur to investigate and examine the effects of the illicit dumping of toxic and dangerous products and wastes in African and other developing countries on the enjoyment of human rights, in particular on the rights to life and health of everyone.
٦١١- في قرارها ٥٩٩١/١٨، رجت اللجنة المقررة الخاصة أن تحقق في آثار اﻹلقاء غير المشروع للمنتجات والنفايات السامة والخطرة في البلدان النامية اﻷفريقية وغيرها من البلدان النامية وبحث هذه اﻵثار على التمتع بحقوق اﻹنسان، ولا سيما حق كل شخص في الحياة وحقه في الصحة.

Consequently, it called on all States to adopt and vigorously implement existing conventions relating to the dumping of toxic and dangerous products and wastes and to cooperate in the prevention of illicit dumping (part I, para. 11).

Nonetheless, the Federal Government and the people of Nigeria reiterate their strong belief that illicit dumping of toxic wastes is a deliberate act aimed at protecting the life and health of the citizens of the countries from which the wastes emanate at the expense of the peoples in the recipient countries.
٣- ومع ذلك، فإن الحكومة الاتحادية وشعب نيجيريا يكرران الاعراب عن اعتقادهما الراسخ بأن القاء النفايات السميـة بشكـل غيـر مشـروع يعـد عملاً متعمداً يهدف إلى حماية حياة وصحة مواطني البلدان التي تأتي منها النفايـات علـى حسـاب الشعوب في البلدان المتلقية لها.

The United Nations Commission on Human Rights has long considered the issue of illicit dumping of toxic and dangerous products and wastes in developing countries to adversely affect the human rights to life and health of individuals.
طالما اعتبرت المفوضية العليا الحقوق الإنسان التابعة للأمم المتحدة قضية التخلص غير المشروع من المنتجات والمخلفات السامة والخطرة في الدول النامية من الأمور التي تؤثر تأثيرا سلبيا على حقوق الإنسان وعلى صحة الفرد وحياته.
