The UNCITRAL Guide on the Implementation of a Security Rights Registry provided commentary and recommendations on legal and practical issues that needed to be addressed in a modern security rights registry.

Adoption of the report of the Commission on this agenda item and of the Technical Legislative Guide on the Implementation of a Security Rights Registry may be expected to take place on Wednesday, 17 July 2013.
ويمكن توقُّع اعتماد تقرير اللجنة عن هذا البند من جدول الأعمال واعتماد الدليل التشريعي التقني بشأن إنشاء وتشغيل سجل للحقوق الضمانية يوم الأربعاء 17 تموز/يوليه 2013.

The Working Group considered a note by the Secretariat entitled " Draft Technical Legislative Guide on the Implementation of a Security Rights Registry " (A/CN.9/WG.VI/WP.50 and Add.1-2).

The Working Group had before it the following documents: A/CN.9/WG.VI/WP.49 (Annotated Provisional Agenda), A/CN.9/WG.VI/WP.50 and Addenda 1-2 (Draft Technical Legislative Guide on the Implementation of a Security Rights Registry), A/CN.9/WG.VI/WP.48 and Addenda 1-2 (Draft Security Rights Registry Guide).

The UNCITRAL Guide on the Implementation of a Security Rights Registry would usefully complement the existing Legislative Guide on Secured Transactions, while the Guide to Enactment of the UNCITRAL Model Law on Cross-Border Insolvency would be of significant help to judges in interpreting and applying certain aspects of the Model Law, thus contributing to the development of uniform practice on the matter.

As to the presentation of the text, it was agreed that the draft Registry Guide should be presented as a separate, stand-alone, comprehensive text that would be consistent with the Secured Transactions Guide, and be tentatively entitled " Technical Legislative Guide on the Implementation of a Security Rights Registry " (A/CN.9/740, para. 30).
أمّا فيما يتعلق بهيئة عرض النص، فقد اتُّفق على أن يُعرَض مشروع دليل السجل في هيئة نص شامل وقائم بذاته ومستقل وأن يكون متّسقاً مع دليل المعاملات المضمونة، وأن يُعنوَن مؤقتاً " الدليل التشريعي التقني لتنفيذ سجل الحقوق الضمانية " (A/CN.9/740، الفقرة 30).

16. In order to address the above-mentioned problems, security interests registries may need to be established or reorganized in accordance with the recommendations of the Guide and the draft Technical Legislative Guide on the Implementation of a Security Rights Registry.
16- ومن أجل معالجة المشاكل المذكورة أعلاه، قد يلزم إنشاء سجلات للمصالح الضمانية أو إعادة تنظيم ما هو موجود منها وفقا لتوصيات الدليل التشريعي ومشروع الدليل التشريعي التقني لتنفيذ سجل للحقوق الضمانية.

The Guide on the Implementation of a Security Rights Registry would help States to build a security registry system that would effectively protect the legitimate rights and interests of creditors, thus reducing transaction risks and fostering trade development.
وأردف قائلا إن الدليل المتعلق بوضع سجل للحقوق الضمانية يساعد الدول على إقامة نظام من شأنه توفير الحماية الفعلية للحقوق والمصالح المشروعة للدائنين، ومن ثم تقليل المخاطر وتعزيز النمو التجاري.
