Replying to the point raised by the representative of Argentina, he said that if a State party to the Convention made no decision at all in accordance with article 287, it would be bound in the event of a dispute relating to the law of the sea to have recourse to arbitration in accordance with Annex VII. He brought to the attention of the Meeting, that, following the Tribunal's Order of 3 December 2001 in the MOX Plant Case, a former President of the Tribunal, Judge Mensah, had been appointed by the parties as President of an arbitral tribunal constituted in accordance with Annex VII of the Convention.
