Article 9, paragraph 1, of the International Covenant on Civil and Political Rights affirms that everyone has the right to liberty and security of person, that no one should be subjected to arbitrary arrest or detention nor be deprived of his or her liberty except on such grounds and in accordance with such procedure as are established by law.
وتؤكد الفقرة 1 من المادة 9 من العهد الدولي الخاص بالحقوق المدنية والسياسية حق الفرد في الحرية والأمان، وأنه لا يجوز توقيف أحد أو اعتقاله تعسفاً ولا ينبغي حرمان أحد من حريته إلا لأسباب ينص عليها القانون وطبقاً للإجراء المقرر فيه.

1. Everyone has the right to liberty and security of person. No one shall be subjected to arbitrary arrest or detention. No one shall be deprived of his liberty except on such grounds and in accordance with such procedure as are established by law.
" 1 - لكل فرد حق في الحرية وفي الأمان على شخصه، ولا يجوز توقيف أحد أو اعتقاله تعسفيا، ولا يجوز حرمان أحد من حريته إلا لأسباب ينص عليها القانون وطبقا للإجراء المقرر فيه.

The Committee recalled that deprivation of liberty is permissible only when it takes place on such grounds and in accordance with such procedure as are established by domestic law and when this is not arbitrary.
وأشارت اللجنة إلى أن الحرمان من الحرية أمر مسموح به فقط عندما يطبق لأسباب معينة ويتماشى مع الإجراءات التي يحددها القانون المحلي وعندما لا يكون تعسفياً.

6. The right of all persons to be secure in their homes, papers and effects against entries, searches and seizures shall not be impaired except upon warrant issued, in accordance with the rules of the Court, for adequate cause and particularly describing the place to be searched and things to be seized, or except on such grounds and in accordance with such procedure as are established by the rules of the Court.
٦ - لا ينتقص من حق جميع اﻷشخاص في أن يكونوا آمنين في بيوتهم وعلى مستنداتهم وأمتعتهم من المداهمات والتفتيش والمصادرة إلا بأمر صادر وفقا للائحة المحكمة، ولسبب وجيه، على أن يبين اﻷمر بشكل خاص المكان الذي سيجري تفتيشه واﻷشياء التي ستجري مصادرتها، أو إلا لﻷسباب ووفقا لﻹجراءات المحددة في لائحة المحكمة.
