The Committee recommends that the requested review of existing legislation consider the need for application of this principle, and in any case to children younger than 16, and in particular to make it a requirement for courts and other institutions to seek and give due weight to the views of the child in all matters affecting the child, in accordance with article 12 of the Convention.
وتوصي اللجنة الدولة الطرف عند قيامها باستعراض التشريعات القائمة المطلوب منها، أن تأخذ في الحسبان الحاجة إلى تنفيذ هذا المبدأ، وذلك في جميع الأحوال بالنسبة للأطفال دون سن 16 عاماً وبالخصوص أن تجعله شرطاً يُلزم المحاكم وغيرها من المؤسسات بالعمل على التماس آراء الطفل في جميع المسائل المتعلقة به واعطائها الوزن الواجب، وذلك وفقاً لأحكام المادة 12 من الاتفاقية.

Therefore, the Committee recommends that States parties continue and strengthen their efforts to take into consideration the views of children with disabilities and facilitate their participation in all matters affecting them within the evaluation, separation and placement process in out-of-home care, and during the transition process.
وتبعاً لذلك، توصي اللجنة الدول الأطراف بأن تواصل وتعزّز جهودها لمراعاة آراء الطفل المعوق وتيسر مشاركته في جميع المسائل التي تهمّه في إطار عملية التقييم والفصل والإيداع في الرعاية خارج إطار الأسرة وأثناء الفترة الانتقالية.
