1. A State party to the present Protocol shall permit visits in accordance with this Protocol to any place in any territory under its jurisdiction where persons deprived of their liberty by a public authority or at its instigation or with its consent or acquiescence are held or may be held.
١- تأذن الدولة الطرف في هذا البروتوكول، وفقاً للبروتوكول، بزيارة أي مكان في أي اقليم يخضع لولايتها القضائية يحتجز فيه أو يمكن أن يحتجز فيه أشخاص محرومون من حريتهم بأمر من سلطة عامة أو بناء على توجيه منها أو بموافقتها أو علمها.

The State party should take effective legislative, administrative and judicial measures to prevent all acts of torture and all illtreatment in any territory under its jurisdiction, including by ensuring that military personnel are not in any way involved in the arrest and detention of civilians.

(12) The Committee is concerned at the judiciary's de facto dependence on the executive, which poses a major obstacle to the immediate institution of an impartial inquiry when there are substantial grounds for believing that an act of torture has been committed in any territory under its jurisdiction.
(12) وتشعر اللجنة بالقلق إزاء تبعية السلطة القضائية تبعيةً فعلية للسلطة التنفيذية، وهو ما يشكّل عائقاً كبيراً أمام بدء تحقيق فوري ونزيه عندما تتوفر أسباب معقولة تدعو إلى الاعتقاد بارتكاب عمل من أعمال التعذيب داخل إقليم يخضع لولاية الدولة الطرف.

States parties should inform the Committee of the legislative, administrative, judicial and other measures they take to prevent and punish acts of torture and cruel, inhuman and degrading treatment in any territory under their jurisdiction.
بل ينبغي للدول الأطراف أن تبلغ اللجنة بما تتخذه من تدابير تشريعية وإدارية وقضائية وغيرها من التدابير لمنع أفعال التعذيب والمعاملة القاسية واللاإنسانية والمهينة في أي أراض خاضعة لولايتها، وللمعاقبة عليها.

These provisions are not consistent with the obligation of every State party to conduct an impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction, to prosecute the perpetrators of such acts and to compensate the victims (arts. 12, 13 and 14).

ينبغي للدولة الطرف أن تراجع قانونها الخاص بالإجراءات الجنائية بغية السماح بفتح تحقيق رسمي وفوري ونزيه عندما يكون هناك من الأسباب ما يدعو إلى الاعتقاد بارتكاب عمل من أعمال التعذيب في إحدى المناطق الخاضعة لولايتها.

In their concluding observations, different committees have urged States parties to recognize and ensure that the human rights treaties apply at all times, whether in peace, war or armed conflict, in any territory under their jurisdiction.
وقد حثَّت مختلفُ اللجان في ملاحظاتها الختامية الدولَ الأطراف على أن تعترف بأن معاهدات حقوق الإنسان واجبة التطبيق في جميع الأوقات، في السلم أو في الحرب أو إبان الصراعات المسلحة وفي أي إقليم يخضع لولاياتها القضائية، وأن تكفل تطبيقها على هذا النحو.
