Its scope would be unnecessarily limited if both parties were required to have their places of business in Contracting States.
فالنطاق سيكون محدودا دون أي مبرر إذا اقتضى الأمر أن يكون للطرفين مقرا عمل في دولة متعاقدة.

It follows that, if neither the place of receipt nor the place of delivery are in a Contracting State and no port of loading or port of discharge is specified in the contract, then the Convention may not apply even though in fact the actual ports of loading and discharge were in Contracting States.

On the scope of application of the Convention, the court stated that the CISG governed the contract as the two parties were located in Contracting States and the substantive requirements for the application of the Convention were met, i.e., the contract was a sales contract of an international nature and the parties did not exclude the application of the Convention.
