2- يُفتَرَضُ أنَّ الأطرافَ في اتفاقات التحكيم المُبرَمَةِ بعد 15 آب/أغسطس 2010 قد أشاروا إلى القواعد بصيغتها السارية في تاريخ بدء التحكيم، ما لم يكن الأطرافُ قد اتَّفَقُوا على تطبيق صيغة مُعيَّنَةٍ للقواعد.

a/ The dollar equivalent of contributions pledged in national currencies has been calculated at the United Nations operational rate of exchange in effect as at 30 June 1994. However, contributions paid are recorded at the rate of exchange in effect on the date of payment or at the actual United States dollar amount if paid in United States dollars.
)أ( حسب المعادل الدولاري للتبرعات المعقودة بالعملات الوطنية على أساس أسعار الصرف المعمول بها في ٣٠ حزيران/يونيه ١٩٩٤، أما التبرعات المدفوعة فقد قيدت على أساس أسعار الصرف المعمول بها وقت الدفع أو على أساس المبلغ الفعلي بدولارات الولايات المتحدة إذا تم الدفع بدولارات الولايات المتحدة.

This Agreement shall be the successor to the International Tropical Timber Agreement, [1994]. All acts by or on behalf of the Organization or any of its organs under the International Tropical Timber Agreement, 1983, which are in effect on the date of entry into force of this Agreement and the terms of which do not provide for expiry on that date shall remain in effect unless changed under the provisions of this Agreement.
2- يستمر نفاذ جميع الإجراءات المتخذة من قبل المنظمة أو أي من أجهزتها أو بالنيابة عنها بموجب الاتفاق الدولي للأخشاب الاستوائية اللجنة لعام [1994] والتي تكون نافذة في تاريخ بدء سريان هذا الاتفاق ولا يكون في شروطها ما لم ينص على انقضائها في ذلك التاريخ، ما لم تتغير بموجب أحكام هذا الاتفاق.

35. Variant 3 received considerable support as providing a precise and simple rule, which put the parties on notice that, if they did not express their agreement to apply the Rules as in effect on the date of their agreement, then the Rules as in effect on the date of the commencement of the arbitration should be presumed to apply.
35- أمّا البديل 3، فقد حظي بقدر كبير من التأييد لكونه يوفر قاعدة دقيقة وبسيطة تنبِّه الأطراف إلى أنّها، إذا لم تعبِّر عن اتفاقها على تطبيق القواعد السارية وقت اتفاقها على التحكيم، وجب عندئذ افتراض انطباق القواعد التي هي سارية وقت بدء التحكيم.

34. Support was expressed for variant 2, which provided that the applicable version of the Rules be the one " as in effect on the date of commencement of the arbitration, subject to such modification as the parties may agree " .
34- وأُبدي تأييد للبديل 2، الذي ينصّ على أنّ الصيغة الواجبة التطبيق من القواعد ينبغي أن تكون تلك " السارية وقت بدء التحكيم، مع مراعاة التعديلات التي قد تتفق عليها الأطراف " .
