The Special Rapporteur, Prof. Julio Barboza, in his sixth report deals extensively and in detail with the liability for harm to the environment in areas beyond national jurisdiction - which Malta had described in its proposal to the United Nations as " extraterritorial spaces " .

Barboza in his sixth report proposed an article on assignment of obligation (article 3) which stipulated that the State of origin had the obligation of reparation provided that it knew or had means of knowing that a relevant activity was being or was about to be carried out in its territory or in other places under its jurisdiction or control.

On the basis of his findings, contained in his sixth report (A/CN.4/546), the Special Rapporteur had concluded -- rightly, in the Mexican delegation's regard -- that although the " clean hands " doctrine might be of importance with regard to the determination of the international responsibility of States, it did not constitute lex specialis applicable to diplomatic protection and therefore should not be included in the draft articles.
