78- وتقضي الفقرة 2 من المادة 31 من الاتفاقية بأن تسعى الدول الأطراف إلى تقليل الفرص المتاحة للجماعات الإجرامية المنظمة لكي تشارك بعائدات الجرائم في الأسواق المشروعة.

In article 31 of the Organized Crime Convention, the importance of tracking and confiscating criminal assets is stressed, with States parties required, under that article, to endeavour to reduce existing or future opportunities for organized criminal groups to participate in lawful markets with proceeds of crime.
وقد جرى التشديد في المادة 31 من اتفاقية الجريمة المنظَّمة على أهمية تعقُّب ومصادرة الموجودات الإجرامية حيث يُطلب إلى الدول الأطراف، بموجب هذه المادة، أن تسعى إلى تقليل الفرص التي تتاح حاليًّا أو مستقبلاً للجماعات الإجرامية المنظَّمة لكي تشارك في الأسواق المشروعة بعائدات الجرائم.

Pursuant to article 31, paragraph 2, of the Convention, States parties are required to endeavour to reduce opportunities for organized criminal groups to participate in lawful markets with proceeds of crime, through appropriate legislative, administrative or other measures.
وعملا بأحكام الفقرة 2 من المادة 31 من الاتفاقية، فإن على الدول الأطراف أن تسعى إلى تقليل الفرص التي تتاح للجماعات الإجرامية المنظّمة لكي تشارك في الأسواق المشروعة بعائدات الجرائم، وذلك باتخاذ ما يلزم من التدابير التشريعية أو الإدارية أو التدابير الأخرى.

2. States Parties shall endeavour, in accordance with fundamental principles of their domestic law, to reduce existing or future opportunities for organized criminal groups to participate in lawful markets with proceeds of crime, through appropriate legislative, administrative or other measures.
2- يتعين على الدول الأطراف أن تسعى، وفقا للمبادىء الأساسية لقانونها الداخلي، الى تقليل الفرص التي تتاح حاليا أو مستقبلا للجماعات الاجرامية المنظمة لكي تشارك في الأسواق المشروعة بعائدات الجرائم، وذلك باتخاذ ما يلزم من التدابير التشريعية أو الادارية أو التدابير الأخرى.

(a) Reducing existing and future opportunities for organized criminal groups to participate in lawful markets with the proceeds of crime, through appropriate legislative, administrative or other measures;
(أ) الحد من الفرص القائمة والمستقبلية أمام الجماعات الإجرامية المنظمة للمشاركة بعائدات الجريمة في الأسواق المشروعة بواسطة تدابير تشريعية أو إدارية أو غيرها من التدابير المناسبة؛

2. States Parties shall endeavour, in accordance with fundamental principles of their domestic law, to reduce existing or future opportunities for offenders to participate in lawful markets with proceeds of crime, through appropriate legislative, administrative or other measures.
2- تسعى الدول الأطراف، وفقا للمبادئ الأساسية لقانونها الداخلي، إلى الحد من الفرص التي تتاح في الوقت الحاضر أو في المستقبل للجناة لكي يشاركوا في الأسواق المشروعة بعائدات الجرائم، باتخاذ ما يلزم من التدابير التشريعية أو الإدارية أو التدابير الأخرى.

(a) Reducing existing and future opportunities for organized criminal groups to participate in lawful markets with the proceeds of crime, through appropriate legislative, administrative or other measures;
(أ) الحد من الفرص المتاحة حاليا ومستقبلا أمام الجماعات الإجرامية المنظمة للمشاركة بعائدات الجريمة في الأسواق المشروعة باتخاذ تدابير تشريعية أو إدارية أو غيرها من التدابير المناسبة؛

Specifically, article 31(2) notes that State Parties shall endeavour " to reduce existing or future opportunities for organized criminal groups to participate in lawful markets with proceeds of crime, through appropriate legislative, administrative or other measures " .
وعلى وجه التحديد، تشير المادة 31 (2) إلى ضرورة أن تسعى الدول الأطراف " إلى تقليل الفرص التي تتاح حاليا أو مستقبلا للجماعات الإجرامية المنظَّمة لكي تشارك في الأسواق المشروعة بعائدات الجرائم، وذلك باتخاذ ما يلزم من التدابير التشريعية أو الإدارية أو التدابير الأخرى " .
