There was general agreement within the Working Group on the importance of the topics under consideration and the usefulness of examining possible electronic substitutes or alternatives for paper-based documents of title and other forms of dematerialized instruments that represented or incorporated rights in tangible goods or rights having monetary value.
88 - وساد داخل الفريق العامل اتفاق عام على أهمية المواضيع قيد النظر وعلى فائدة دراسة البدائل الإلكترونية الممكنة للاستعاضة عن المستندات الورقية للملكية وغيرها من الأوراق المالية ذات الشكل غير المادي التي تمثل أو تتضمن حقوقا في السلع الملموسة أو الحقوق التي لها قيمة نقدية.

The Working Group therefore agreed to recommend to the Commission that the Secretariat be requested to study further the issues related to transfer of rights, in particular rights in tangible goods, by electronic means and mechanisms for publicizing and keeping a record of acts of transfer or creation of security interests in such goods.

89. According to one view, the question of the transferability of rights in tangible goods or other rights in an electronic environment touched upon numerous issues, such as property law, in which legal systems varied greatly.

Another view was that it would be useful for the Working Group to examine issues related to the establishment of registries or other methods of achieving negotiability of rights through electronic means with a view to devising appropriate systems for publicizing the transfer of rights in tangible goods, security interests or other rights.

In December 2000, the Secretariat prepared a paper for Working Group IV entitled " Possible future work on electronic commerce: Transfer of rights in tangible goods and other rights " (A/CN.9/WG.IV/WP.90). This paper was prepared in contemplation of the completion of its work on the Model Law on Electronic Signatures in 2001, and identified and explained many issues involved in this subject.
