3. Article 21, paragraph 3: The wording " or at a later stage in the arbitral proceedings if the arbitral tribunal decides that the delay was justified under the circumstances " might be deleted since this point is covered in a more comprehensive way in draft article 22.

3. In its statement of defence, or at a later stage in the arbitral proceedings if the arbitral tribunal decides that the delay was justified under the circumstances, the respondent may make a counterclaim or rely on a claim for the purpose of a set-off provided that the arbitral tribunal has jurisdiction over it.
3- يجوزُ للمُدَّعَى عليه أن يُقدّمَ في بيان دفاعه، أو في مرحلة لاحقة من إجراءات التحكيم إذا رأت هيئةُ التحكيم أنَّ الظروف تسوِّغ هذا التأخير ، دعوى مضادة أو أن يستند إلى دعوى مُقامة لغرض الدفع بالمقاصّة، شريطة أن تكون هيئةُ التحكيم مختصَّةً بذلك.

The provisions on arbitration in the project agreement or in a separate arbitration agreement should also deal with a number of practical matters, such as: the number of arbitrators who are to comprise the arbitral tribunal; the procedures for appointing the arbitrators; the place where the proceedings are to be held and where the arbitral award is to be issued; the language to be used in the arbitral proceedings.
٨٤ - ينبغي ﻷحكام البنود الخاصة بالتحكيم في اتفاق المشروع أو اتفاق تحكيم منفصل ، أن تعنى أيضا بعدد من المسائل العملية ، مثل : عدد المحكمين الذين تشتمل عليهم هيئة التحكيم ؛ واجراءات تعيين المحكمين ؛ والمكان الذي تعقد فيه اجراءات التحكيم والمكان الذي يصدر فيه قرار التحكيم ؛ واللغة المراد استخدامها في دعاوى التحكيم .
