21- ومع أن الأسعار وحدها هي التي يمكن مقارنتها خلال المناقصة العلنية، فإن المعايير غير السعرية، كالنوعية مثلا، يمكن أن تُقَيَّم بصورة مستقلة قبل المناقصة العلنية ثم تُضَمُ فيما بعد، باستخدام برامجيات متخصصة للمناقصة العلنية، إلى المعلومات المقدمة في المناقصة العلنية لوضع ترتيب عام للمورّدين.

(5) The procuring entity shall send an invitation to participate in the auction to all suppliers or contractors except for those who have not been prequalified, or whose tenders have been rejected in accordance with article 34 (3).
(5) يتعيّن على الجهة المشترية أن توجّه دعوة للمشاركة في المناقصة إلى جميع المورّدين أو المقاولين باستثناء الذين لم يتأهّلوا مسبقا أو الذين رُفضت عطاءاتهم وفقا للمادة 34 (3).

(6) The invitation to participate in the auction shall set out the manner and deadline by which suppliers and contractors shall register to participate in the auction.
(6) يتعيّن أن تبيّن الدعوة إلى المشاركة في المناقصة كيفية تسجيل المورّدين والمقاولين للمشاركة فيها والموعد النهائي لذلك التسجيل.

(7) The procuring entity shall ensure that the number of suppliers or contractors invited to participate in the auction is sufficient to secure effective competition.
(7) يتعيّن على الجهة المشترية أن تكفل أن يكون عدد المورّدين أو المقاولين المدعوّين للمشاركة في المناقصة كافيا لضمان تنافس فعّال.

12. This detailed information may be provided in the notice of the ERA itself or, by reference, in the rules for the conduct of the auction, provided that all relevant information is made known to all suppliers or contractors sufficiently in advance before the auction, to allow them to properly prepare for participation in the auction.
12- ويمكن تقديم هذه المعلومات المفصّلة في إشعار المناقصة الإلكترونية نفسها، أو بالإشارة إليها في قواعد إجراء المناقصة، شريطة إطلاع المورِّدين أو المقاولين كافة على جميع المعلومات ذات الصلة قبل إجراء المناقصة بوقت كاف، وذلك لتمكينهم من الاستعداد السليم للمشاركة في المناقصة.

The provisions of paragraph (1) require that, in addition to all the other information required to be provided to suppliers or contractors, the procuring entity must specify that an ERA will be held, must provide the mathematical formula to be used during the auction and must disclose all other information necessary for participation in the auction.
وتقضي أحكام الفقرة (1)، بالإضافة إلى جميع المعلومات الأخرى التي يلزم تزويد المورِّدين أو المقاولين بها، بوجوب أن تبيّن الجهة المشترية أنها ستجري مناقصة إلكترونية وأن توفر الصيغة الرياضية المُزمع استخدامها خلال المناقصة وأن تفصح عن جميع المعلومات الأخرى اللازمة للمشاركة في المناقصة.

(e) To reword the last sentence to read as follows: " It also gives the right to the procuring entity to cancel the auction in accordance with article 51 quater if the number of suppliers or contractors registered to participate in the auction is insufficient to ensure effective competition during the auction " ;
(ﻫ) إعادة صياغة الجملة الأخيرة ليصبح نصها كالآتي: " وهي تعطي الجهة المشترية أيضا الحق في إلغاء المناقصة وفقا للمادة 51 مكررا ثالثا إذا كان عدد المورّدين أو المقاولين المسجلين للمشاركة في المناقصة غير كافٍ لضمان التنافس الفعّال أثناء المناقصة " ؛
