4. Secondly, the question of admissibility before the Committee must be determined not in the light of the complaint as made before a domestic court, but in the light of the complaint laid before the Committee and this complaint is well laid out in paragraphs 2.1 to 3.5 in the Committee's Views.
4- ثانياً، إن تناول اللجنة لمسألة مقبولية البلاغ ينبغي أن يتمّ في ضوء الشكوى كما عُرضت على اللجنة وليس كما قُدّمت أمام المحاكم المحلية. وهذه الشكوى معروضة بشكل جيد في الفقرات من 2-1 إلى 3-5 من آراء اللجنة.

It further submits that the arguments contained in the Committee's Views contain no reference to any new circumstance which would lead to reopening of the proceedings owing to newly discovered evidence.

In this regard, the State party informs the Committee that it did not press for costs when a judgement was rendered in its favour by the Judicial Committee of the Privy Council in December 2011, in the related case referred to in the Committee's Views.

The author appended a copy of Act No. 19/2003, which entered into force in Spain at the end of December 2003; as mentioned in the Committee's Views in Gómez Vásquez, the Act generalizes a second level of jurisdiction in criminal cases, instituting appeals against judgements by provincial courts and the National High Court.
وأرفق صاحب البلاغ نسخة عن القانون رقم 19/2003 الذي أصبح نافذاً في إسبانيا في أواخر كانون الأول/ديسمبر 2003؛ وعلى نحو ما جاء في آراء اللجنة في قضية غومِس فاسكِس، فإن القانون يُضفي طابعاً عاماً على مستوى ثانٍ من المحاكمة في القضايا الجنائية، بتقديم طلبات استئناف طعناً في الأحكام الصادرة عن محاكم المقاطعات والمحكمة العليا الوطنية.

4.2 The State party informed the Committee that it " refrains from conducting logging activities in the Angeli area (paragraph 10.1 in the Committee's Views in case No. 671/1995, 30 October 1996) that would affect the exercise by the individual authors' reindeer husbandry while their communication is under consideration by the Committee " .
