At the forty-first plenary meeting, held on 23 March 1994, the Governing Council asked me to bring to your attention and that of the Secretary-General its members' concern at the fact that the Security Council is to take decisions on the first compensation payments over the next few months, inasmuch as the funding available in the Compensation Fund is insufficient for such payments.

5. For an initial period, successful claimants in categories A, B and C will receive all funds available in the Compensation Fund for paying claims, until each has received payment of the initial amount referenced in paragraph 2 above.
٥ - لفترة أولية، يحصل أصحاب المطالبات المجازة في الفئات ألف وباء وجيم، على جميع اﻷموال المتاحة في صندوق التعويضات لسداد المطالبات، إلى أن يحصل كل منهم على دفعة المبلغ اﻷولي المشار إليه في الفقرة ٢ أعلاه.

(b) Under phase two, the funds available in the Compensation Fund for the payment of the 48 claims remaining following the completion of phase one, will be allocated as follows:

وقد نظر أيضاً في الطلب الذي قدمته حكومة العراق لكي لا يُجرى الدفع الفصلي المقرر إجراؤه في كانون الثاني/يناير 2015 ولكي يُعاد إليها ما يوجد حالياً في صندوق التعويضات من ودائع قدمتها حكومة العراق منذ 1 تشرين الأول/أكتوبر 2014 لسداد ذلك الدفع،

1. Decides that an additional amount equivalent to 10 per cent of the value of each of the Phased Project awards will be withheld in the Compensation Fund for release in accordance with phasing plans submitted and approved in accordance with decision 258, and subject to further decisions of the Governing Council;
1- يقرر أن يُحتَجز في صندوق التعويضات مبلغ إضافي يعادل ما نسبته 10 في المائة من قيمة كل مبلغ تعويض ممنوح لكل من المشاريع المنفَّذة على مراحل، على أن يُفرَج عن هذه المبالغ المُحتَجزة وفقاً لخطط التنفيذ على مراحل المقدَّمة والمعتَمَدة وفقاً للمقرر 258، ورهناً بأي مقررات أخرى يتخذها مجلس الإدارة؛

4. Reaffirms that the mandatory withholding of fifteen per cent of the total value of the awards subject to decision 258(2005) shall be retained in the Compensation Fund pending further decisions of the Governing Council as to the disposition of those funds;
4- يؤكد من جديد أن مبالغ الاحتجاز الإلزامي بموجب المقرر 258(2005) لما نسبته 15 في المائة من مجموع قيمة المبالغ الممنوحة سوف تُستبقى في صندوق التعويضات إلى أن يتخذ مجلس الإدارة مقررات أخرى فيما يتعلق بالتصرف بهذه الأموال؛
