(د) إذا تبين أن الشخص المعني سيحاكم أو يعاقب في الدولة الأجنبية بسبب نوع جنسه أو عرقه أو ديانته أو جنسيته أو رأيه السياسي.

(c) a law currently in force in the foreign State that would render the answering of that question or the production of that document or thing by that person in its own jurisdiction an offence.

Article 12, section 1, of the Criminal Code establishes that citizens of the Russian Federation and stateless persons habitually resident in the Russian Federation who have committed offences outside the Russian Federation are liable to prosecution under the Criminal Code if the acts committed by them are offences in the State in whose territory they were committed and if the persons have not been convicted in the foreign State.
ينص البند 1 من المادة 12 من قانون العقوبات على أن مواطني الاتحاد الروسي والأشخاص عديمي الجنسية المقيمين عادة في الاتحاد الروسي ممن يرتكبون جرائم خارج أراضي الاتحاد الروسي يحاكمون بموجب قانون العقوبات إذا كانت الأفعال التي ارتكبوها مُصنَّفة جرائم في الدولة التي ارتكبت على أراضيها وإذا لم يكن صدر في الدولة الأجنبية حكم بحق الأشخاص الذين ارتكبوها.

On the basis of article 12.1 of the Criminal Code, citizens of Azerbaijan and permanent residents of Azerbaijan who are stateless and who commit crimes beyond the borders of Azerbaijan are subject to criminal liability under the Criminal Code of Azerbaijan, if such acts are considered a crime in Azerbaijan and in the State in whose territory the act was committed, and if such persons have not been tried in the foreign State.
وبناء على المادة 12-1 من القانون الجنائي، فإن مواطني أذربيجان وعديمي الجنسية المقيمين فيها بصفة دائمة، الذين يرتكبون جرائم خارج حدود أذربيجان، معرضون لتحمل التبعة الجنائية طبقا للقانون الجنائي لأذربيجان، إذا كانت تلك الأعمال مما يعتبر جريمة في أذربيجان وفي الدولة التي ارتكب الفعل في إقليمها، وإذا كان هؤلاء الأشخاص لم يحاكموا في الدولة الأجنبية المعينة.

On the basis of article 12.1 of the Criminal Code, Azerbaijani nationals and stateless persons permanently residing in Azerbaijan who commit actions or omissions beyond the borders of Azerbaijan are subject to criminal liability under the Criminal Code of Azerbaijan, if these are considered a crime in Azerbaijan and in the State in whose territory they were committed, and if such persons have not been tried in the foreign State.
ووفقا للفقرة 1 من المادة 12 من قانون الجزاءات، يُعاقب المواطنون وعديمو الجنسية المقيمون بصفة دائمة بأذربيجان، والذين يرتكبون فعلا ما (بأدائه أو إغفاله) خارج البلد بعقوبات جنائية وفق هذا القانون، إذا ما كان الفعل قيد النظر يشكل جريمة بأذربيجان وفي البلد الذي ارتُكب به، وذلك في حالة عدم إدانة هؤلاء الأشخاص في الدولة الأجنبية.
