Belgium believes it must be clearly stated that this paragraph is without prejudice to the remedies that may be invoked in the State of the forum in order to obtain pecuniary compensation in the event of unfair dismissal (which must obviously include equivalent acts of breaking a contract of employment).
ترى بلجيكا أن من الضروري أن يشار بوضوح الى أن هذه الفقرة الفرعية لا تخل بسبل الانتصاف التي يمكن أن تكون متاحة، في دولة المحكمة بغية الحصول على تعويض نقدي في حالة الفصل غير القانوني )الذي يجب أن تضم إليه بطبيعة الحال أعمال الاخلال بعقد العمل المشابهة(.

21. Paragraph (b) of article 14 provides that States shall not enjoy immunity in proceedings relating to “an alleged infringement by the State, in the territory of the State of the forum, of a right of the nature mentioned in subparagraph (a) [patents, intellectual property, etc.] which belongs to a third person and is protected in the State of the forum”.
٢١ - تنص الفقرة )ب( من المادة ١٤ على أن الدولة ليس لها التمتع بالحصانة في دعوى تتصل " بتعدٍ يُدعى أن الدولة قامت به، في إقليم دولة المحكمة، على حق من النوع المذكور في الفقرة الفرعية )أ( ]براءات الاختراع والممتلكات الفكرية وما إلى ذلك[ يخص الغير ويتمتع بالحماية في دولة المحكمة " .

22. This rule is understood to apply only to cases in which the State commits acts that involve a clear infringement of an intellectual property right enjoyed by a person in the State of the forum (e.g., the commercial exploitation of a product which has been patented in the said State).
٢٢ - وتُفهم هذه القاعدة على أنها لا تسري إلا على الحالات التي ترتكب فيها الدولة أفعالا تشكل تعديا واضحا على حق الملكية الفكرية الذي يتمتع به شخص ما في دولة المحكمة )ومن ذلك مثلا الاستغلال التجاري لمنتج مسجلة براءته في الدولة المذكورة(.
