That article envisages recognition on only two grounds -- as either a " foreign main proceeding " or a " foreign non-main proceeding " . The former is a foreign proceeding that is taking place in the State where " the debtor has the centre of its main interests " , while the latter is a foreign proceeding taking place in a State where the debtor has " an establishment " .

In Betcorp, for example, the judge held that the time at which the centre of main interests should be determined was the time at which the application for recognition was made. That interpretation seems to arise from the tense in which the definition of " foreign main proceeding " is expressed: " means a foreign proceeding taking place in the State where the debtor has the centre of its main interests " .

The question often discussed by practitioners is the enforceability of such measures, both in the State where the arbitration is taking place and in other States.
