A consignee may be bound to arbitrate in the selected venue even in the absence of the consignee's agreement, provided only that the arbitration agreement is in the transport document and that the consignee received timely and adequate notice.

It was emphasized that there was no connection between the qualifying clause and the condition of the container upon delivery, and that the carrier was not automatically relieved of responsibility by the existence of a qualifying clause in the transport document.
وجرى التأكيد على أن لا علاقة بين البند التحفظي وحالة الحاوية عند تسليمها وأن الناقل لا يُعفى تلقائيا من المسؤولية بسبب وجود بند تحفظي في مستند النقل.
