114. With respect to those specific cases where an undertaking would stipulate that payment was to be made by a bank other than the guarantor or issuer, it was generally agreed that such a stipulation should be interpreted as implying also that another place was stipulated in the undertaking.
١٤١ - أما فيما يتعلق بتلك الحالات المحددة التي ينص فيها التعهد على السداد عن طريق مصرف لا عن طريق الكافل أو المصدر، فقد اتفق عموما على تفسير هذا الحكم بكونه يعني أيضا اشتراط مكان آخر في التعهد.

1. The beneficiary's right to demand payment may be transferred only if authorized in the undertaking, and only to the extent and in the manner authorized in the undertaking.
١ - لا يجوز نقل حقل المستفيد في المطالبة بالسداد إلا إذا كان التعهد يأذن بذلك، وإلا بالقدر والكيفية المأذون بهما في التعهد.

(a) Stipulated in the undertaking or demonstrated by the terms and conditions of the undertaking; or
)أ( قد نص عليه في التعهد أو يتبين من شروط وأحكام التعهد؛ أو

" 1. If an ascendant of the detainee or her spouse, guardian or a relative gives an undertaking to guarantee her well-being, good conduct and behaviour and to pay the amount determined by the court in the undertaking in the event of any breach thereof;
1- إذا قدم أحد أصول المحجوزة أو زوجها أو من له الولاية عليها أو أحد أقربائها تعهداً يلتزم فيه حسن تربتها وسيرتها وسلوكها ويدفع المبلغ الذي تحدده المحكمة في التعهد إذا وقع الإخلال به.

(b) The beneficiary and the guarantor/issuer have agreed on the termination of the undertaking in the form stipulated in the undertaking or, failing such stipulation, in a form referred to in paragraph 2 of article 7;
)ب( اتفق المستفيد والكفيل/المصدر على انهاء التعهد بالشكل المنصوص عليه في التعهد أو بشكل من اﻷشكال المشار اليها في الفقرة ٢ من المادة ٧ في حالة عدم وجود مثل هذا النص؛

It was suggested that paragraph (3) should be limited to the general statement of principle contained in its opening words, establishing that payment could be made in any form stipulated in the undertaking.
واقترح أن تقتصر الفقرة )٣( على البيان العام للمبدأ الوارد في عبارتها الاستهلالية، والذي يقرر إمكانية السداد بأية صورة منصوص عليها في التعهد.

(1) For the purposes of this Convention, an undertaking is independent where the guarantor's or issuer's obligation to the beneficiary is not subject to the existence or validity of an underlying transaction or to any term or condition not appearing in the undertaking.
)١( ﻷغراض هذه الاتفاقية، يكون التعهد مستقلا حينما لا يكون التزام الكفيل أو المصدر تجاه المستفيد مرهونا بوجود أو صلاحية معاملة أصلية أو بأي حكم أو شرط لا يظهر في التعهد.

(b) If expiry depends according to the undertaking on the occurrence of an act or event not within the guarantor/issuer's sphere of operations, when the guarantor/issuer is advised that the act or event has occurred by presentation of the document specified for that purpose in the undertaking or, if no such document is specified, of a certification by the beneficiary of the occurrence of the act or event;
)ب( اذا كان الانقضاء يتوقف حسبما ورد في التعهد على وقوع فعل أو واقعة لا تدخل في نطاق عمليات الكفيل/المصدر، فعندما يبلﱠغ الكفيل/المصدر بوقوع الفعل أو الواقعة بتقديم المستند المحدد في التعهد لذلك الغرض، أو اذا لم يحدد ذلك المستند، فبتقديم شهادة مصدقة من المستفيد بوقوع الفعل أو الواقعة؛

(a) A secured creditor's rights in proceeds under an independent undertaking are subject to the rights, under the law and practice that govern independent undertakings, of the guarantor/issuer, confirmer or nominated person and of any other beneficiary named in the undertaking or to whom a transfer of drawing rights has been effected;
(أ) أن حقوق الدائن المضمون في العائدات بمقتضى تعهد مستقل تخضع لما يكفله القانون والممارسة اللذان يحكمان التعهدات المستقلة من حقوق للكفيل/المُصدر أو الشخص المسمّى وأي مستفيد آخر ذُكر اسمه في التعهد أو أحيلت حقوق السحب إليه؛

(a) At the expiry date, which may be a specified calendar date or the last day of a fixed period of time stipulated in the undertaking, provided that, if the expiry date is not a business day at the place of business of the guarantor/ issuer at which the undertaking is issued, or of another person or at another place stipulated in the undertaking for presentation of the demand for payment, expiry occurs on the first business day which follows;
)أ( في تاريخ الانقضاء، الذي قد يكون تاريخا تقويميا محددا أو اليوم اﻷخير من فترة زمنية محددة منصوص عليها في التعهد، على أنه اذا لم يكن تاريخ الانقضاء يوم عمل في مكان عمل الكفيل/ المصدر الذي يصدر فيه التعهد، أو مكان عمل شخص آخر، أو في مكان آخر منصوص عليه في التعهد لتقديم المطالبة بالسداد، يقع الانقضاء في أول يوم عمل يليه؛
