113. Respect for this right is the core element of a fair trial and has constitutional rank in Tunisian law. Article 108 of the Constitution provides that the right of legal recourse and the right to a defence are guaranteed and that the law must provide for legal assistance to be offered to persons without means.
113- إنّ احترام هذا الحق هو جوهر المحاكمة العادلة وله في القانون التونسي مرتبة دستورية إذ نصّ الفصل 108 من الدستور على أن حق التقاضي وحق الدفاع مضمونان وأنّ القانون يكفل لغير القادرين مالياً الإعانة العدلية.
