The Committee in 2009 adopted two new general comments, No. 11 and No. 12, on indigenous children and their rights under the Convention and the right of the child to be heard.

24. In 2009, the Committee on the Rights of the Child issued general comment No. 11 on indigenous children and their rights under the Convention, which calls for basic measures to be taken in support of the implementation of the rights of indigenous children.

In the light of its general comment No. 11 (2009) on indigenous children and their rights under the Convention, the Committee recommends that the State party take all the necessary measures to preserve the cultural and linguistic identity and heritage of indigenous children by ensuring that they receive basic education in their native language to the extent possible.

The Plan should take into account indigenous peoples and children and their right to participate, in a culturally sensitive manner, taking into account the Committee's general comment No. 11 (2009) on indigenous children and their rights under the Convention.
