III. NATURE AND SCOPE OF THE RIGHT OF indigenous peoples to own, USE, CONTROL, AND MANAGE
ثالثاً- طبيعة ونطاق حق الشعوب الأصلية في امتلاك واستخدام أراضيها

7. CERD recommended that States parties adopt policies to eliminate racism against indigenous peoples; undertake special measures to recognize and protect the rights of indigenous peoples to own, develop control and use their communal lands and territories; and compensate indigenous peoples affected by development projects on their lands.
7- وأوصت اللجنة الدول الأطراف بأن تنتهج سياسات ترمي إلى مكافحة العنصرية ضد الشعوب الأصلية؛ وتتخذ تدابير خاصة للاعتراف بحقوق الشعوب الأصلية في امتلاك أراضيها وأقاليمها الجماعية وتنميتها والسيطرة عليها واستغلالها وحماية هذه الحقوق؛ وأن تدفع تعويضات للشعوب الأصلية المتأثرة بتنفيذ المشاريع على أراضيها.

The Committee also notes with concern that the right of indigenous peoples to own land is not respected and that mineral, timber and other commercial interests have been allowed to expropriate, with impunity, large portions of land belonging to indigenous peoples.

It drew the State parties' attention to general recommendation No. 23 on the rights of indigenous peoples which, inter alia, calls upon State parties to recognize and protect the rights of indigenous peoples to own, develop, control and use their communal lands, territories and resources.

36. It is also important to recall the principles of international law concerning indigenous peoples as defined by the Inter-American Commission on Human Rights, including the right of indigenous peoples to own, control and manage their territories.
36- ومن المهم كذلك الإشارة إلى مبادئ القانون الدولي فيما يخص الشعوب الأصلية كما عرّفتها لجنة البلدان الأمريكية لحقوق الإنسان، بما في ذلك حق الشعوب الأصلية في امتلاك أقاليمها والتحكم فيها وإدارتها.

Bearing in mind its general recommendation 23 on the rights of indigenous peoples, in particular paragraph 5 thereof, the Committee calls upon the State party to take steps to recognize and protect the rights of indigenous peoples to own, develop, control and use their communal lands and territories.
