It is advisable to review existing constitutional provisions so as to eliminate undesirable restrictions to private sector participation in Infrastructure development and operation, or unnecessary limitations to the use of public property by private entities and obstacles to private ownership of infrastructure.
ومن المستصوب اعادة النظر في اﻷحكام الدستورية الراهنة بغية القضاء على القيود غير المرغوب فيها التي تعرقل مشاركة القطاع الخاص في انشاء وتشغيل البنية التحتية ، أو القضاء على التقييدات التي تحد من استخدام الملكية العامة من جانب كيانات من القطاع الخاص ، والقضاء على العقبات أمام الملكية الخاصة للبنية التحتية .

Some legal systems allow the concessionaire to terminate the project agreement if the concessionaire’s performance has been rendered substantially more onerous by the occurrence of an unforeseen change in conditions and the parties have failed to agree on an appropriate revision to adapt the project agreement to the changed conditions (see chap. V, “Infrastructure development and operation”, ___).
