- The International Safety Management Code (ISM Code) is expected to become mandatory on 1 July 1998;

It had hoped that draft article 14 would be based on the principle of due diligence, both before the voyage and throughout it to the point of final delivery, in the light of the obligations placed on shipowners, as a result of the International Safety Management (ISM) code and other laws affecting shipping.

14. Enforcement of IMO safety and anti-pollution provisions has been strengthened by the incorporation into the International Convention on the Safety of Life at Sea of the International Safety Management Code, under which companies operating ships are subject to a safety management system under the control of the administration of the flag State.

76. The IMO Assembly adopted guidelines on implementation of the International Safety Management Code by administrations, which became necessary when amendments to Code came into effect on 1 July 2010.

As reported by IMO, the International Safety Management (ISM) Code, which imposes rules upon shipping companies to ensure the sound management of safety and pollution prevention standards, became mandatory under the International Convention for the Safety of Life at Sea (SOLAS 1974) for all tankers, bulk carriers, gas carriers, passenger ships and cargo high-speed craft of 500 gt and above in 1998.

43. A recent assessment of the status of implementation of the International Safety Management Code and its impact carried out by a group of independent experts concluded that where the Code was embraced as a positive step, tangible positive benefits were evident.

For example, the Paris Memorandum of Understanding has developed a common training programme and code of conduct for port State control officers (see FSI 14/7/4) and several Memorandums of Understanding have established timetables for further concentrated inspection campaigns, focusing in particular on the International Safety Management Code.

83. In addition to the information it provided on the ISM Code as described above (para. 54), IMO reported on the adoption by its Assembly at its 21st session of resolution A.880(21), entitled " Implementation of the International Safety Management (ISM) Code by 1 July 2002 " .

147. The Maritime Safety Committee also approved for consideration and adoption at the twentieth session of the Assembly a draft resolution on implementation of the International Safety Management (ISM) Code (see MSC 68/23, annex 6).

The adoption of the International Safety Management (ISM) Code; the establishment of the IMO Subcommittee on Flag State Implementation; the expanded role that has been given to the IMO secretariat in monitoring the implementation of the STCW Convention, and the growing number of Memoranda of Understanding for regional port State control all attest to this change of emphasis.

This work is gaining increasing significance, taking into consideration that the International Safety Management Code became mandatory for many categories of vessels as of 1 July 1998.
