Afghanistan is a party to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, and its Constitution guarantees the fundamental rights essential to a fair trial, including the right to counsel, the presumption of innocence and prohibition against the use of torture and arbitrary detention.
