3 - تتخذ كل دولة طرف التدابير اللازمة لتقرير ولايتها القضائية فيما يتصل بالجرائم المشار إليها في المادة 2 في الحالات التي يكون فيها مرتكب الجريمة المفترض موجودا في إقليمها وفي حالات عدم قيامها بتسليمه إلى أي من الدول الأطراف التي قررت ولايتها القضائية وفقا للفقرة 1 أو 2.

4. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in article 2 in cases where the alleged offender is present in its territory and it does not extradite that person to any of the States Parties for the reason that:

٤ - تتخذ كل دولة متعاقدة ما يلزم من تدابير ﻹقامة ولايتها على الجرائم المشار إليها في المادة ٢ إذا كان المدعى ارتكابه الجريمة موجودا في إقليمها ولم تقم بتسليمه الى أي من الدول المتعاقدة التي أقامت ولايتها وفقا للفقرة ١ أو ٢.
