ورغم أن إسماعيل الخزمي لم يعد يعتبر مختفياً، لأن وفاته تأكدت، لا تزال أسرته تعاني حزناً يعادل حزها على اختفائه، وذلك لعدم تمكنها من الحصول على أي معلومات عن مصير إسماعيل الخزمي وملابسات وفاته.

The authors accordingly submit that the mental suffering caused by the State's refusal to clarify the circumstances of Ismail Al Khazmi's death also amounts to a continuing breach of article 7 of the Covenant in his regard.
ومن ثم، يدفع صاحبا البلاغ بالقول إن المعاناة النفسية الناجمة عن رفض الدولة توضيح ظروف وفاة إسماعيل الخزمي تشكل انتهاكاً متواصلاً للمادة 7 من العهد بحقه.

Accordingly, the Committee considers that the inescapable conclusion is that the State party has violated Ismail Al Khazmi's right to life, in breach of article 6, paragraph 1, of the Covenant.
ومن ثم، تستنتج اللجنة حتماً أن الدولة الطرف انتهكت حق إسماعيل الخزمي في الحياة، وبذلك فإنها تكون قد انتهكت الفقرة 1 من المادة 6 من العهد.

The Committee is of the view, in the circumstances, that Ismail Al Khazmi's right to recognition as a person before the law was violated as a result of his intentional removal from the protection of the law, in breach of article 16 of the Covenant.
