The International Law Commission pointed out in paragraph 3 of its commentary on article 55, dealing with the rule of speciality, or rule of identity between transfer and trial, that it was for the State which the court has requested to waive the requirements laid down in paragraphs 1 or 2 of that article to decide the matter.

In its commentary on article 1 of the Covenant Egypt explained its national view of the right to self-determination as well as its steadfast policy of ensuring full compliance therewith, since the right to self-determination is the natural and true point of departure from which all the principles of human rights and fundamental freedoms enshrined in international law flow and is also the means by which they are realized.
