1 - إذا لم تقم الدولة الطرف التي يوجد في إقليمها مرتكب الجريمة المفترض بتسليم ذلك الشخص، تكون ملزمة بإحالة القضية، دون إبطاء لا لزوم له وبدون أي استثناء وسواء كانت الجريمة قد ارتكبت أو لم ترتكب في إقليمها، إلى سلطاتها المختصة لغرض الملاحقة الجنائية حسب إجراءات تتفق مع قوانين تلك الدولة.

Moreover, under article 7 of the Convention, the State party is obliged to submit the present case to its competent authorities for the purpose of prosecution or, failing that, since Belgium has made an extradition request, to comply with that request, or, should the case arise, with any other extradition request made by another State, in accordance with the Convention.
كما أن الدولة الطرف ملزمة، بموجب المادة 7 من الاتفاقية، بعرض هذه القضية على سلطاتها المختصة لمباشرة إجراءات المحاكمة الجنائية وإلا، ما دام هناك طلب بالتسليم صادر عن بلجيكا، بقبول هذا الطلب أو القبول، عند الاقتضاء، بأي طلب آخر بالتسليم صادر عن دولة أخرى طبقاً لأحكام الاتفاقية.

5. If an extradition request is made with respect to an offence described in article 3.1 and if the requested State Party does not or will not extradite, on the basis of the nationality of the offender, that State shall take suitable measures to submit the case to its competent authorities for the purpose of prosecution.
5 - إذا ما قُدم طلب لتسليم مجرم فيما يتعلق بجريمة من الجرائم الوارد ذكرها في المادة 3-1 وإذا ما كانت الدولة الطرف المتلقية للطلب لا تسلم أو لن تسلم المجرم، استناداً إلى جنسية المجرم يجب على تلك الدولة أن تتخذ التدابير الملائمة لعرض الحالة على السلطات المختصة فيها لغرض المقاضاة.

79. Paragraph 10 of article 16 requires a State party that has denied extradition of a person on the ground of nationality to submit the case to its competent authorities for the purpose of prosecution.
79- وتقتضي الفقرة 10 من المادة 16 أن تقوم الدولة الطرف التي رفضت تسليم شخص بسبب الجنسية بإحالة القضية إلى سلطاتها المختصة بقصد الملاحقة.

1. The State Party in the territory under whose jurisdiction a person alleged to have committed an offence of enforced disappearance is found shall, if it does not extradite that person or transfer him or her in accordance with its international obligations to another State or transfer him or her to an international criminal tribunal whose jurisdiction it has recognized, submit the case to its competent authorities for the purpose of prosecution.
1- على الدولة الطرف التي يُعثر في إقليم خاضع لولايتها القضائية على المرتكب المفترض لجريمة اختفاء قسري، أن تحيل القضية إلى سلطاتها المختصة لمباشرة الدعوى الجنائية، إن لم تسلم الشخص المعني أو لم تحله، وفقاً لالتزاماتها الدولية إلى دولة أخرى، أو لم تحله إلى محكمة جنائية دولية تعترف باختصاصها.

" 5. If an extradition request is made with respect to an offence described in article 3.1 and if the requested State Party does not or will not extradite, on the basis of the nationality of the offender, that State shall take suitable measures to submit the case to its competent authorities for the purpose of prosecution.

A Party which declines a request to extradite a person for bribery of a foreign public official solely on the ground that the person is its national shall submit the case to its competent authorities for the purpose of prosecution.
ويجب على الطرف الذي لا يوافق على تسليم شخص من أجل إرشاء موظف أجنبي فقط على أساس أنه من مواطنيه أن يعرض القضية على سلطاته المختصة بغرض المحاكمة.
