Victims should be provided with effective access to legal remedies, including the right to seek just and adequate reparation for any damage suffered as a result of a racist or xenophobic crime.
وينبغي أن توفر للضحايا سبل انتصاف قانونية فعالة بما في ذلك حقهم في طلب تعويضات عادلة وكافية عن أي أضرار تكبدوها نتيجة جريمة مرتبطة بدوافع عنصرية أو بكره الأجانب.

In this respect, the Special Rapporteur urges States to guarantee to victims of racism and racial discrimination full access to effective legal remedies, including the right to seek just and adequate reparation.

(d) Ensuring that people of African descent have full access to effective protection and remedies through the competent national tribunals and other State institutions against any acts of racial discrimination, and the right to seek from such tribunals just and adequate reparation or satisfaction for any damage suffered as a result of such discrimination;
(د) كفالة تمتع المنحدرين من أصل أفريقي على نحو تام بالحماية الفعلية وسبل الإنصاف المتاحة عبر المحاكم الوطنية المختصة ضد ما قد يتعرضون له من أعمال التمييز العنصري، والحق في الحصول، عبر هذه المحاكم، على الجبر أو الترضية بشكل عادل وبالقدر الكافي عن أي ضرر يصيبهم نتيجة لهذا التمييز؛

The Committee was aware that the follow-up measures raised the issue of just and adequate reparation or satisfaction referred to in article 6 of the Convention.
وقد كانت اللجنة على علم بأن تدابير المتابعة تثير مسألة تقديم تعويض عادل ومناسب أو ترضية عادلة ومناسبة، المشار إليها في المادة ٦ من الاتفاقية.

Doubts were expressed whether victims of racial discrimination have effective remedies at their disposal for seeking just and adequate reparation from the competent tribunals.
٩٦٤ - وأعرب عن الشكوك فيما إذا كان يتاح لضحايا التمييز العنصري سبل انتصاف فعالة لالتماس تعويض عادل ومناسب من المحاكم المختصة.

The Committee urges the State party to strengthen its efforts to combat violence against women, ensuring that all cases of violence against women are thoroughly investigated, that the alleged perpetrators are put on trial and, if convicted, given an appropriate sentence and that victims receive redress, including just and adequate compensation.
تحث اللجنة الدولة الطرف على تكثيف جهودها الرامية إلى مكافحة العنف الممارس على المرأة، بضمان التحقيق على نحو وافٍ في جميع حالات العنف هذه، ومحاكمة الجُناة المشتبه بهم، وتوقيع عقوبات مناسبة عليهم إذا ثبتت إدانتهم، وحصول الضحايا على الجبر، بما يشمل تقديم تعويضات عادلة ومناسبة.

In that regard, he mentioned the international norms contained in the International Convention on the Elimination of All Forms of Racial Discrimination, and the relevance of article 6 thereof, which dealt with effective protection and remedies, as well as just and adequate reparation or satisfaction.

Article 6 complements the provisions of article 4 by requesting from States parties that they ensure to everyone within their jurisdiction effective protection and remedies against acts of racial discrimination as well as just and adequate reparation or satisfaction for any damage suffered as a result of such discrimination.
وتستكمل المادة 6 أحكام المادة 4 حيث تطلب من الدول الأطراف أن تكفل لكل إنسان يعيش ضمن ولايتها القضائية حماية فعالة من أفعال التمييز العنصري وسبل انتصاف فعالة فيما يتعلق بذلك، وتعويضاً عادلاً ومناسباً أو ترضية عادلة ومناسبة عن أي ضرر لحقه نتيجة لهذا التمييز.

120. In connection with article 6 of the Convention, the Committee requests that information be provided on the availability of the right to seek from the courts just and adequate reparation or satisfaction for any damage suffered as a result of racial discrimination.
١٢٠ - وفيما يتصل بالمادة ٦ من الاتفاقية، تطلب اللجنة تقديم معلومات عن وجود الحق في أن يطلب من المحاكم جبر عادل مناسب أو ترضية عادلة مناسبة ﻷي أضرار حصلت نتيجة للتمييز العنصري.

579. With respect to article 6 of the Convention, concern is expressed over the lack of legislative provisions to implement the right to just and adequate reparation or satisfaction for any damage suffered as a result of acts of racial discrimination.
٥٧٩ - وفيما يتعلق بالمادة ٦ من الاتفاقية، يُعرب عن القلق للافتقار إلى أحكام تشريعية متعلقة بتنفيذ الحق في التماس جبر أو تعويض عادل مناسب عن أي ضرر يلحق نتيجة للتمييز العنصري.

The Committee recommends that more publicity be given to make the public aware of the right to seek from national tribunals just and adequate reparation for any damage suffered as a result of racial discrimination.
وتوصي اللجنة بأن ينشر قدر أكبر من المعلومات لتوعية الجمهور بحق الرجوع إلى المحاكم الوطنية للحصول على تعويضات عادلة وكافية عن أية أضرار لحقت بهم نتيجة للتمييز العنصري.

The Committee also recommends that the State party intensify its efforts to ensure to everyone within its jurisdiction effective protection against any act of racial discrimination, as well as the right to seek just and adequate reparation or satisfaction for any damage suffered as a result of such discrimination.
كما توصي اللجنة الدولة الطرف بتكثيف جهودها لضمان الحماية الفعلية لكل فرد مشمول بولايتها القضائية من أي فعل من أفعال التمييز العنصري، وكذلك ضمان الحق في التماس جبر أو تعويض عادل وكاف عن أي ضرر يقع نتيجة هذا التمييز.

The practical effect of that law was said to prevent the relatives of disappeared persons and other victims of human rights violations from finding out the truth and receiving just and adequate compensation for the suffering to which they had been subjected.
وقيل إن الآثار العملية لهذا القانون تتمثل في منع أقارب الأشخاص المختفين وغيرهم من ضحايا انتهاكات حقوق الإنسان من معرفة الحقيقة والحصول على تعويض منصف وملائم عما تعرضوا له من معاناة.

وإذ تشير إلى أن المادة 6 من الاتفاقية تقتضي من الدول الأطراف أن تكفل لكل فرد يدخل في نطاق ولايتها حماية وسبل انتصاف فعالة، عن طريق المحاكم وغيرها من المؤسسات المختصة التابعة للدولة، من أية أفعال تمييز عنصري، فضلاً عن حقه في أن يلتمس من هذه المحاكم تعويضات أو ترضية منصفة وكافية عن أية أضرار يتكبدها نتيجة لهذا التمييز،

The Committee recommends to the State party that it inform victims of racial discrimination of their rights, including remedies available to them, that it facilitate their access to justice and guarantee their right to just and adequate reparation.
توصي اللجنة الدولة الطرف بأن تعلم ضحايا التمييز العنصري بحقوقهم، بما فيها ما يتاح لهم من سبل الانتصاف، وأن تيسر وصولهم إلى العدالة وتكفل لهم حقهم في انتصافٍ عادل وملائم.

24. The Government has called attention to provisions of the Agreement on Normalization of Relations between the Republic of Croatia and the Federal Republic of Yugoslavia that provide for the return of possession of property or just and adequate compensation.
٢٤ - ووجهت الحكومة الانتباه إلى أحكام اتفاق تطبيع العلاقات بين جمهورية كرواتيا وجمهورية يوغوسلافيا الاتحادية التي تنص على إعادة الممتلكات أو التعويض العادل والكافي.
