While domestic legislation includes provisions for maintenance allowance (Affiliation and Maintenance of Children Act, Penal Code and Juveniles Act), the Committee is concerned at the lack of implementation of these provisions, mainly because of widespread ignorance of the law and limited enforcement of maintenance orders, notably when the parent concerned lives abroad.

Articles 1 and 31 of the Juveniles Act provides for the establishment of this mechanism and detail its functions.

Article 8 of the Juveniles Act No. 1 of 1994 prescribes the penalties that may be imposed on minors, which do not include capital punishment.

If the person is a juvenile, however, those prescribed in the Juveniles Act are applicable.

Corporal punishment is also lawful in alternative care settings under article 8 of the Juveniles Act.

93. The draft of the new Juveniles Act raises the age of criminal responsibility of juveniles to 11.

A criminal action cannot be brought against a child under the age of nine, however grave the offence. The new draft Juveniles Act raises the age of criminal responsibility of juveniles to 11.

182. The Juveniles Act accordingly make three distinctions among juveniles, as set out below, with respect to measures and penalties.

According to article 1 of the Syrian Juveniles Act of 1974, a child is any male or female below 18 years of age.
حسب المادة 1 من قانون الأحداث السوري لعام 1974، فإن الطفل هو كل ذكر أو أنثى لم يكمل/ تكمل العام الثامن عشر من العمر.

The Juveniles Act deals with the subjects of physical and psychological recovery and reintegration (arts. 10 to 15).

The Juveniles Act attempted to ensure that its provisions covered two categories of juveniles:

Article 28 of the Juveniles Act made provision for the establishment of juvenile courts vested with sole jurisdiction to hear cases involving juveniles accused of a felony or a misdemeanour.
168- نصت المادة 28 من قانون الأحداث على تشكيل محاكم خاصة للأحداث تختص وحدها دون غيرها في النظر في أمر الحدث عند اتهامه في جناية أو جنحة.

277. Article 8 of the Juveniles Act provides that: " The Department of Public Prosecutions shall be directly responsible for the examination and handling of juvenile cases.
277- ونصت المادة 8 من قانون رعاية الأحداث على أن " تتولى النيابة مباشرة إجراءات التحقيق والتصرف في مسائل الأحداث.

Numerous measures have been taken to ensure that children are protected against all forms of abuse and exploitation, as can be seen from the Penal Code (Act No. 16 of 1960) and the Juveniles Act No. 3 of 1983;
تم اتخاذ العديد من التدابير التي تكفل تحقيق الحماية من كافة أوجه الإساءة للأطفال واستغلالهم، ويظهر ذلك في قانون الجزاء رقم(16) لسنة 1960 وقانون الأحداث رقم(3) لسنة 1983.
