492. The Committee welcomes the adoption of Dahir No. 1-02-172 in June 2002 revising Dahir No. 1-93-165 which regulates the kafalah system, but is concerned that its implementation may encounter difficulties.

As she had already pointed out, far from obliging States to recognize adoption, the Convention acknowledged that some States did not recognize such a system, and explicitly mentioned the kafalah of Islamic law in its article 20.

55. When a child is to be placed for adoption or kafalah of Islamic law and finally will be adopted or placed in kafalah, it is vitally important that the child is heard.
55- عندما يتقرر إيداع الطفل من أجل تبنيه أو كفالته حسب الشريعة الإسلامية ويُتبنى أو يُكفل في نهاية المطاف، من الأهمية القصوى الاستماع إلى الطفل.
