Having concluded its consideration of communication No. 1057/2002, submitted to the Human Rights Committee on behalf of Mr. Alexander Kornetov under the Optional Protocol to the International Covenant on Civil and Political Rights,

1.2 On 5 March 2002, the Human Rights Committee, acting through its Special Rapporteur on New Communications and Interim Measures, pursuant to rule 92 of the Committee's rules of procedures, requested the State party not to execute Mr. Kornetov while his case was under consideration by the Committee.
1-2 في 5 آذار/مارس 2002، طلبت اللجنة المعنية بحقوق الإنسان، متصرِّفةً من خلال مقررها الخاص المعني بالبلاغات الجديدة والتدابير المؤقتة، وفقاً للمادة 92 من نظامها الداخلي، من الدولة الطرف أن توقف تنفيذ الحكم بالإعدام الصادر بحق السيد كورنيتوف ريثما تفرغ اللجنة من النظر في قضيته.

On 7 January 2002, Mr. Kornetov's lawyer appealed to the President of the Supreme Court under a supervisory procedure, asking for the reopening of the case and further investigations.
وبتاريخ 7 كانون الثاني/يناير 2002، قدم محامي السيد كورنيتوف استئنافاً إلى رئيس المحكمة العليا في إطار إجراء إشرافي، طالباً إعادة فتح ملف القضية وإجراء المزيد من التحقيقات.

Finally, it indicates that on 19 February 2002, the Supreme Court commuted Mr. Kornetov's death sentence to 20 years' imprisonment.
وأخيراً، تشير الدولة الطرف إلى أنه بتاريخ 19 شباط/فبراير 2002، خفّفت المحكمة العليا الحكم بالإعدام الصادر بحق السيد كورنيتوف إلى حكمٍ بالسجن لمدة 20 سنة.

25. With regard to the case of Kornetov v. Uzbekistan (communication No. 1057/2002), he said that the State party, in implementation of the Committee's recommendations, had commuted Mr. Kornetov's death sentence to 20 years' imprisonment.
25 - وفيما يتعلق بقضية كورنيتوف ضد أوزبكستان (البلاغ رقم 1057/2002)، قال إن الدولة الطرف، تنفيذا لتوصيات اللجنة، قد خففت حكم السيد كورنيتوف من الإعدام إلى السجن لمدة 20 سنة.

This was true for cases Nos. 996/2001 (Stolyar v. the Russian Federation), 1039/2001 (Zvozskov et al. v. Belarus), 1057/2002 (Kornetov v. Uzbekistan) and 1391/2005 (Rodrigo v. Spain).

9. In accordance with article 2, paragraph 3 (a), of the Covenant, the State party is under an obligation to provide Mr. Kornetov with an effective remedy. The remedy could include consideration of a reduction of his sentence and compensation.
9- وتعتبر اللجنة، بموجب الفقرة 3(أ) من المادة 2 من العهد، أن الدولة الطرف مُلزَمة بأن توفر للسيد كورنيتوف سبيل انتصاف ملائماً يمكن أن يشمل التعويض والنظر في تخفيف الحكم.

This was true for cases Nos. 996/2001 (Stolyar v. the Russian Federation), 1039/2001 (Zvozskov et al. v. Belarus), 1057/2002 (Kornetov v. Uzbekistan) and 1391/2005 (Rodrigo v. Spain).

In cases Nos. 1057/2002 (Kornetov v. Uzbekistan), 1108/2002 and 1121/2002 (Karimov and Nursatov v. Tajikistan) and 1140/2002 (Khudayberganov v. Uzbekistan), the Committee also found violations of article 7, read together with article 14, paragraph 3 (g), of the Covenant.
وفي القضايا 1٠57/2٠٠2 (كورنيتوف ضد أوزبكستان) و11٠8 و1121/2٠٠2 (كريموف وآخرون ضد طاجيكستان)، و114٠/2٠٠2 (خودايبيرغانوف ضد أوزبكستان)، خلصت اللجنة أيضاً إلى حدوث انتهاك للمادة 7 بالاقتران مع الفقرة 3(ز) من المادة 14 من العهد.

192. In case No. 1057/2002 (Kornetov v. Uzbekistan) regarding a violation of article 7, read together with article 14, paragraph 3 (g), of the Covenant, the Committee declared that the State party was under an obligation to provide the author with an effective remedy.
192- وفي القضية 1٠57/2٠٠2 (كورنيتوف ضد أوبكستان) المتعلقة بحدوث انتهاك للمادة 7، بالاقتران مع الفقرة 3(ز) من المادة 14 من العهد، أعلنت اللجنة أن الدولة الطرف مُلزمة بأن تكفل لصاحب البلاغ سبيل انتصاف فعالاً.

In cases Nos. 1057/2002 (Kornetov v. Uzbekistan), 1108/2002 and 1121/2002 (Karimov and Nursatov v. Tajikistan) and 1140/2002 (Khudayberganov v. Uzbekistan), the Committee also found violations of article 7, read together with article 14, paragraph 3 (g), of the Covenant.

192. In case No. 1057/2002 (Kornetov v. Uzbekistan) regarding a violation of article 7, read together with article 14, paragraph 3 (g), of the Covenant, the Committee declared that the State party was under an obligation to provide the author with an effective remedy.

170. The Committee found violations of article 14, paragraph 3 (g), read together with article 7 of the Covenant, in other cases such as Nos. 1017/2001 and 1066/2002 (Strakhov and Fayzullaev v. Uzbekistan), 1041/2002 (Tulayganov v. Uzbekistan), 1043/2002 (Chikunova v. Uzbekistan), 1057/2002 (Kornetov v. Uzbekistan), 1108/2002 and 1121/2002 (Karimov and Nursatov v. Tajikistan) and 1140/2002 (Khudayberganov v. Uzbekistan).

170. The Committee found violations of article 14, paragraph 3 (g), read together with article 7 of the Covenant, in other cases such as Nos. 1017/2001 and 1066/2002 (Strakhov and Fayzullaev v. Uzbekistan), 1041/2002 (Tulayganov v. Uzbekistan), 1043/2002 (Chikunova v. Uzbekistan), 1057/2002 (Kornetov v. Uzbekistan), 1108/2002 and 1121/2002 (Karimov and Nursatov v. Tajikistan) and 1140/2002 (Khudayberganov v. Uzbekistan).
