Furthermore, the Panel finds that Furukawa did not provide sufficient evidence that the claimed tools and equipment were present in Kuwait as at 2 August 1990.

The claimant provided relevant proof of presence in Iraq or Kuwait as at 2 August 1990 through the submission of a Kuwaiti civil identification number and a photocopy of a passport with an exit stamp showing the claimant's departure from Kuwait or Iraq within the jurisdictional period.

With respect to the items of tangible property for which there is a purchase invoice showing purchase of the subject item in the United States and no proof of import into Kuwait, the Panel finds that Engineering-Science did not provide sufficient information and evidence to prove that the subject items were located in Kuwait as at 2 August 1990.
509- أما فيما يتعلق ببنود الممتلكات المادية التي توجد لها فواتير شراء تثبت شراء البند موضوع المطالبة في الولايات المتحدة ولا يوجد إثبات باستيرادها إلى الكويت، يرى الفريق أن شركة Engineering-Science لم تقدم معلومات وأدلة كافية لإثبات أن البنود موضوع المطالبة كانت موجودة في الكويت في 2آب/أغسطس 1990.

In relation to claims for loss of tangible property in Kuwait, the Panel requires sufficient evidence that the claimed property was (a) owned by the claimant, and (b) situated in Kuwait as at 2 August 1990.
166- فيما يتعلق بالمطالبات بتعويض عن خسائر الممتلكات المادية في الكويت، يطلب الفريق توفير أدلة كافية تثبت أن الممتلكات المزعومة كانت (أ) ملكاً للجهة المطالبة؛ و(ب) موجودة في الكويت في 2 آب/أغسطس 1990.

Hitachi was requested in the article 34 notification to provide further information and evidence to demonstrate ownership and presence of the claimed property in Kuwait as at 2 August 1990, but it did not respond to the article 34 notification.
وطُلب إلى شركة هيتاشي، في الإخطار المنصوص عليه في المادة 34، أن تقدم معلومات وأدلة إضافية تثبت أنها تملك الممتلكات المطالب بها وأن تلك الممتلكات كانت موجودة في الكويت في 2 آب/أغسطس 1990، لكنها لم تقدم رداً على الإخطار المنصوص عليه في المادة 34.

The Panel considers that a claim for the loss of tangible property is compensable in principle if a claimant can show (a) that the tangible property assets were in Kuwait as at 2 August 1990, and (b) that such assets were lost or destroyed during the period of Iraq's invasion and occupation of Kuwait.
297- ويرى الفريق أن المطالبة بخسائر الممتلكات المادية هي مطالبة مستحقة التعويض من حيث المبدأ بشرط أن تتمكن الجهة المطالبة من إثبات: (أ) أن أصول الممتلكات المادية كانت موجودة في الكويت حتى 2 آب/أغسطس 1990، و(ب) أن هذه الأصول قد فُقدت أو أُتلفت في فترة غزو العراق واحتلاله للكويت.
