85. Some claimants who were not satisfied by the UNCC Governing Council decision on their claim took legal action against the decision in Kuwaiti courts.
85 - عمد بعض أصحاب المطالبات غير الراضين عن القرار الذي اتخذه مجلس إدارة اللجنة بشأن مطالباتهم إلى اتخاذ إجراءات قانونية ضد القرار في المحاكم الكويتية.

The claimant provided further evidence that it commenced legal proceedings against its insurer in the Kuwaiti courts in March 1992.

6. It is clear from the above article that treaties concluded by the State of Kuwait have the force of law in Kuwait and so they can be invoked by all and are binding on the Kuwaiti courts.
6- ويتبين من هذه المادة أن المعاهدات التي تبرمها دولة الكويت لها قوة القانون داخل الكويت فيخاطب بها الكافة ويلتزم القضاء الكويتي بأحكامها.

175. The above-mentioned principle is well established in the jurisprudence of Kuwaiti courts. Every trade union or businessmen's association is deemed to be a corporate entity in the eyes of the law as of the date the founding documents are filed with the Ministry.
175- ولقد استقر القضاء الكويتي في أحكامه على المبدأ المشار إليه أعلاه وأكد على ميلاد النقابة أو الاتحاد واكتسابهما الشخصية القانونية من تاريخ إيداع أوراق إشهارها لدى الوزارة المختصة.

100. The Kuwaiti courts have heard various cases involving the above-mentioned offences, including the case previously referred to in this report.
100- وفقد تناول القضاء الكويتي قضايا مختلفة بشأن الجرائم المشار إليها أعلاه. ومن بينها تلك المشار إليها سابقاً في هذا التقرير.

192. In the light of the domestic legal protection accorded to this right and the aforementioned important Constitutional Court ruling in this regard, the Kuwaiti courts have overwhelmingly upheld this right when hearing cases involving its exercise by individuals, as shown in the following table:
192- في ظل الحماية القانونية الوطنية لهذا الحق وحكم المحكمة الدستورية المهم والمبين سابقاً، فقد نظر القضاء الكويتي قضايا تتعلق بممارسة الأفراد لهذا الحق، وكان جانحاً إلى تأكيده.

109. These are acts committed by individuals and Kuwait and its various agencies will spare no effort to deal with them and to prosecute and punish the perpetrators. In this connection, reference may be made to the deterrent sentences handed down recently by the Kuwaiti courts to defendants found guilty of sexually or physically abusing female migrant domestic workers.
109- وهذه الحالات الفردية في حالة حدوثها فإن دولة الكويت وأجهزتها المختلفة لا تألو جهداً في سبيل مكافحتها، واتخاذ الإجراءات القانونية ضد مرتكبيها وتوقيع أشد العقوبات عليهم، ويمكن الرجوع في هذا الصدد إلى الأحكام الرادعة التي أصدرها القضاء الكويتي في الآونة الأخيرة ضد البعض ممن قاموا بالإساءة الجنسية والبدنية لبعض الخادمات الأجنبيات.

They are entitled to apply to the Kuwaiti courts for legal redress against individuals or official bodies and there is no discrimination between them and citizens in this respect
لهم حق اللجوء للمحاكم الكويتية دون تمييز بينهم وبين المواطن، سواء ضد الأفراد أو الجهات الرسمية .

The Kuwaiti courts, headed by the Constitutional Court, play a major role at their different levels in the promotion and protection of human rights, both through the judgements that they hand down and the principles and rules which they specify.
للقضاء الكويتي من خلال مختلف درجاته وعلى رأسها المحكمة الدستورية دور كبير في تعزيز واحترام حقوق الإنسان، وذلك من خلال ما يصدره من أحكام ومبادئ وأسس واضحة.
