2. Legislation Act No. 16 of 1960 promulgating the Kuwaiti Penal Code.
قانون رقم ٦١ لسنة ٠٦٩١ بإصدار قانون الجزاء الكويتي.

81. The articles of the Kuwaiti Penal Code lay down penalties for practices detrimental to the interests of the child, as follows:
81- وحددت مواد قانون الجزاء الكويتي عقوبات على ممارسات تضر بمصلحة الطفولة وجاءت على النحو التالي:

In addition to the provisions of the Constitution which set forth the rights of the younger generation vis-à-vis the State, Kuwait has promulgated numerous legislative enactments to protect children from any form of moral or physical exploitation, as can clearly be seen from the heavier penalties prescribed in the Kuwaiti Penal Code for offences against minors.
ولم تكتف دولة الكويت بما جاء في الدستور لتوضيح ما للناشئ من حقوق على الدولة بل سنت الكثير من القوانين والتشريعات بهدف حماية الأطفال من أي استغلال أدبي أو بدني ويبدو ذلك جلياً فيما تناوله قانون الجزاء الكويتي من تشديد العقوبة على الجاني إن كان المجني عليه في القضية قاصراً.

222. Article 1 of the Kuwaiti Penal Code provides for another pivotal principle, i.e., no act constitutes a crime, and no penalty shall be applied thereto, except by virtue of a provision made by law.
222- كما أن المادة الأولى من قانون الجزاء الكويتي نصت على مبدأ أساسي آخر وهو أنه لا يعد الفعل جريمة، ولا يجوز توقيع عقوبة من أجله إلا بناء على نص في القانون.

Kuwait reported that measures to prevent trafficking in women and the exploitation of prostitution of women were included in the Kuwaiti Penal Code (Act No. 16 of 1960), which contained strict legal provisions making these acts punishable offences.
وأفادت الكويت بأن قانون العقوبات الكويتي رقم 16 لعام 1960 ينص على تدابير لمنع الاتجار بالنساء واستغلالهن لأغراض البغاء، كما أنه يتضمن أحكاما قانونية صارمة تجعل هذه الأفعال جرائم يعاقب عليها القانون.

117. In addition to the above provisions which deal with the penalties for the qualified acts mentioned therein, the Kuwaiti Penal Code goes even farther to confer maximum safeguards with respect to inflicting physical harm or abusing the inviolability of the human person in any way. Articles 160 to 164 and article 166 of the Penal Code qualify such acts as criminal acts.
117- وعلاوة على النصوص المشار إليها والتي تناولت المسائل المتعلقة بالتجريم والمعاقبة عليها، فقد مضى المشرع الجزائي الكويتي إلى ابعد من ذلك باسباغه لأقصى أنواع الحماية القانونية للقضايا المتعلقة بسلامة الجسم أو الإخلال بحرمته، بأي شكل من الأشكال، إذ جرم هذه الأفعال بمقتضى المواد من 160 إلى 164 والمادة 166 من قانون الجزاء الكويتي.

From the above provisions, it is evident that the exploitation of prostitution of women and children is prohibited under the Kuwaiti Penal Code, which stipulates heavier penalties for offenders who perpetrate such acts against members of either category.
مما تقدم من نصوص يتضح أن استغلال النساء والأطفال في الدعارة محظور بموجب قانون الجزاء الكويتي الذي شدد العقوبات على الجناة إن كانت تلك الأفعال التي ترتكب موجهة ضد هاتين الفئتين.

5. Article 15 of the Kuwaiti Penal Code states that judgements of juvenile courts must not take account of an individual's previous criminal records.
`5` حثت المادة 15 من قانون الجزاء الكويتي على أن (لا تحسب أحكام محكمة الأحداث ضمن السوابق في صحيفة الحالة الجنائية).

The Kuwaiti legislature devotes a special chapter of the 1983 Kuwaiti Penal Code to a series of provisions that demonstrate its concern for children's rights and desire to deliver justice to children to the fullest extent possible, as illustrated by the articles below.
كما أورد المشرع الكويتي باباً خاصاًَ في قانون الجزاء الكويتي لسنة 1983 تناول فيه سلسلة من المواد لبيان مدى اهتمامه بحقوق الطفل ومحاولة منهم لتطبيق أكبر قدر ممكن من العدالة بحق الحدث حيث أتت المواد التالية:

Kuwaiti Penal laws criminalize inciting or aiding in the commission of a criminal act in keeping with the criminalization of the act itself. The ministries concerned monitor religious sermons, schools, universities and the media in order to prevent the incitement to commit terrorist acts.
تنص قوانين الجزاء الكويتي على تجريم التحريض على الأفعال الإجرامية والمساعدة عليها وذلك بالتوافق مع تجريم الفعل نفسه كما أن الوزارات المعنية تقوم بمتابعة المنابر الدينية والمدارس والجامعات ووسائل الإعلام لمنع التحريض عن الأعمال الإرهابية.

ينص قانون الجزاء الكويتي على تجريم التحريض على الأفعال الإجرامية والمساعدة عليها وذلك بالتوافق مع تجريم الفعل نفسه كما أن الوزارات المعنية تقوم بمتابعة المنابر الدينية والمدارس والجامعات ووسائل الإعلام لمنع التحريض على الأعمال الإرهابية.

In this respect, article 20 of the Kuwaiti Penal Code No. 16 of 1960 provides that when a juvenile who has completed 14 years but has not completed 18 years of age commits a crime punishable by the death sentence, the judge shall render a term of imprisonment of no more than 15 years.
وبخصوص ما جاء في هذه الفقرة فإن قانون الجزاء الكويتي رقم 16 لسنة 1960 نص في المادة 20 على أنه إذا ارتكب الحدث الذي أتم الرابعة عشر ولم يتم ثمانية عشر سنة كاملة، جريمة عقوبتها الإعدام حكم القاضي عليه بالحبس مدة لا تجاوز خمس عشرة سنة.

116. To complement the above-mentioned legal framework, articles 120, 121 and 125 of the Kuwaiti Penal Code address the punishment of public officials who cause harm or injury to others.
116- واستكمالاً لموقف التشريعات المشار إليها فلقد تطرقت المواد 120 و121 و125 من قانون الجزاء الكويتي إلى مسألة معاقبة الموظفين العمومين في حالة الإضرار بالأفراد أو الإساءة إليهم.

252. Under the Kuwaiti Penal Code, assembly in a public place is not prohibited unless the purpose of assembly is to commit a crime or to disturb public order (ordre public).
252- ووفقاً لأحكام قانون الجزاء الكويتي فإن التجمهر في مكان عام لا يمنع إلا إذا كان الغرض منه ارتكاب الجرائم أو الإخلال بالأمن العام.

Article 186 of the above—mentioned Kuwaiti Penal Code stipulates that: “Anyone who has sexual intercourse with a woman without her consent, through the use of force, threats or deception, shall be punished by the death penalty or life imprisonment.
نصت المادة ٦٨١ من قانون الجزاء الكويتي المشار إليه على أن: " من واقع أنثى بغير رضاها، سواء باﻹكراه أو بالتهديد أو بالحيلة، يعاقب باﻹعدام أو الحبس المؤبد.

249. ٩٤٢- ولم تكتف دولة الكويت بما جاء في الدستور لتوضيح ما للنشء من حقوق على الدولة، بل سنت الكثير من القوانين والتشريعات بهدف حماية اﻷطفال من أي استغلال أدبي أو بدني ويبدو ذلك جلياً في ما تناوله قانون الجزاء الكويتي من تشديد العقوبة على الجاني إن كان المجني عليه في القضية قاصراً.

67. Article 18 of the Kuwaiti Penal Code stipulates that anyone who was under seven years of age at the time of committing an offence cannot be held criminally responsible.
67- كما نصت المادة 18 من قانون الجزاء الكويتي على أنه لا يسأل جزائياً من لم يبلغ من العمر وقت ارتكاب الجريمة سبع سنين كاملة.

Article 18 of the Kuwaiti Penal Code (Act No. 16 of 1960) stipulates that “anyone who, at the time of committing an offence, was under 7 years of age shall not be liable to criminal prosecution”.
ونصت المادة ٨١ من قانون الجزاء الكويتي رقم ٦١ لسنة ٠٦٩١ " على أنه لا يسأل جزائيا من لم يبلغ من العمر وقت ارتكاب الجريمة سبع سنين كاملة " .

(b) The Kuwaiti Penal Code (Act No. 16 of 1960).
)ب( قانون الجزاء الكويتي رقم ٦١ لسنة ٠٦٩١: تضمن قانون الجزاء الكويتي لبعض اﻷحكام المتعلقة بحماية الطفولة باﻹضافة إلى بعض اﻷحكام المتعلقة باﻷحداث.

55. In confirmation of this right, article 109 of the Kuwaiti Penal Code prescribes a penalty of up to one year's imprisonment and/or a fine of up to 1,000 rupees for anyone who, in full awareness of the significance of his acts, destroys, damages or desecrates premises intended for religious observance or commits therein an act prejudicial to the requisite respect for the religion concerned.
٥٥- وتأكيداً لهذا الحق فقد نصت المادة ٩٠١ من قانون الجزاء الكويتي على معاقبة كل من خرب أو أتلف أو دنس مكاناً معداً ﻹقامة شعائر دينية، أو أتى في داخله عملاً يخل بالاحترام الواجب لهذا الدين، وكان عالماً بدلالة فعله بالحبس مدة لا تزيد سنة واحدة وبغرامة لا تجاوز ألف روبية أو بإحدى هاتين العقوبتين.

HRW recommended stopping the arrest of individuals based on their sexual orientation or gender identity or presentation and repealing articles 193 and 198 of the Kuwaiti Penal Code, criminalizing consensual homosexual conduct and imitating the appearance of a member of the opposite sex, respectively.
وأوصت منظمة رصد حقوق الإنسان بوقف اعتقال الأشخاص على أساس ميلهم الجنسي أو هويتهم الجنسية أو مظهرهم وبإلغاء المادتين 193 و198 من قانون العقوبات الكويتي اللتين تجرمان السلوك الجنسي المثلي القائم على التراضي وتقليد مظهر الجنس الآخر، على التوالي(65).

23. The State of Kuwait condemns all forms of violence, and especially domestic violence against vulnerable social categories such as children and women, and the legal corpus addresses such cases by criminalizing all acts of violence. This is illustrated by articles 9 and 10 of the Constitution and the provisions of the Kuwaiti Penal Code (Act No. 16 of 1960), as amended, which stipulate as follows:
