2.11 It must be noted however that in the instance of discrimination on the grounds of pregnancy, while both the Employment Equity Act, 1998 (Act 55 of 1998), and the Equality Act, prohibit such discrimination, and the Basic Conditions of Employment Act, 1997 (Act 75 of 1997), provides for protected maternity leave, the limitation is that the latter Act does not make clear provisions for remuneration during maternity leave.
