1. The author of the communication, dated 7 April 2004, is Laureano Oubiña Piñeiro, a Spanish national born in 1946.

The State party informed the Committee that despite the investigations having been carried out to date the whereabouts of Ana Celis Laureano are unknown.
أبلغت الدولة الطرف اللجنة بأنه رغم التحقيقات التي أُجريت حتى الآن، لا يزال مكان وجود آنا سيليس لاوريانو غير معروف.

In the instant case, the State party has not furnished any information other than that Ms. Laureano's disappearance is being investigated.
ولم تقدم الدولة الطرف في هذه القضية أي معلومات ما عدا أن التحقيق في اختفاء اﻵنسة لاوريانو جار.

It is noted that, in spite of those findings, Ms. Laureano has not been located, no criminal proceedings have been instituted and her family has not been compensated.
ولوحظ أنه برغم هذه النتائج، لم يعثر بعد على اﻵنسة لوريانو ولم تقم دعوى جنائية، وأن أسرتها لم تعوض عن اختفائها.

Accordingly, the Committee considered that the fact that Ms. Laureano's case was registered before the Working Group on Enforced or Involuntary Disappearances did not make it inadmissible under that provision.
ورأت اللجنة بالتالي أن وجود قضية اﻵنسة لوريانو مسجلة أمام الفريق العامل المعني بحالات الاختفاء القسري أو غير الطوعي لا يجعلها قضية غير مقبولة بموجب هذا الحكم من العهد.

1. The author of the communication, dated 30 April 2003, is Laureano Oubiña Piñeiro, a Spanish national born in 1946.
1- صاحب البلاغ المؤرخ في 30 نيسان/أبريل 2003 هو لوريانو أوبينيا بينييرو، وهو مواطن إسباني من مواليد عام 1946.

The Committee regretted the absence of cooperation on the part of the Peruvian authorities and, recalling its general comment on article 6, found that Ana Laureano's right to life, enshrined in that article, had not been effectively protected by the State party.
وأعربت اللجنة عن أسفها لعدم تعاون سلطات بيرو، وقررت، مشيرة إلى تعليقها العام على المادة 6، أن الدولة الطرف لم تحترم حق أنا لوريانو في الحياة الوارد في تلك المادة احتراماً فعليا.

It concludes that, in the circumstances, Ms. Laureano did not benefit from such special measures of protection as she was entitled to because of her status as a minor, and that there has been a violation of article 24, paragraph 1.
وتخلص اللجنة في هذه الظروف إلى أن اﻵنسة لوريانو لم يتح لها ما تستحقه من تدابير حماية خاصة بصدد مركزها كقاصر، وأن الفقرة ١ من المادة ٢٤ قد انتهكت.

According to the author, the police had no conclusive evidence of his involvement in drug trafficking and what they were trying to do was to find a way of obtaining evidence against Laureano Oubiña.
ويرى صاحب البلاغ أنه لم يكن بحوزة الشرطة أي دليل قاطع يثبت ضلوعه في الاتجار بالمخدرات وأن ما كانت تحاول القيام به هو إيجاد طريقة للحصول على دليل ضد السيد لوريانو أوبينا.

1. The author of the communication is Basilio Laureano Atachahua, a Peruvian citizen, born in 1920.

2.12 In the light of the above, it is contended that all available domestic remedies to locate Ana Celis Laureano and to ascertain whether she is still alive have been exhausted.
٢-١٢ ويدعى على ضوء ما سبق أن جميع سبل الانتصاف المحلية لتحديد مكان وجود آنا روزاريو سيليس لاوريانو وللتأكد من أنها ما زالت على قيد الحياة قد استنفدت.

The latter notes that in December 1992 investigations carried out by the security and armed forces confirmed that members of the military base in Ambar had arrested Ana R. Celis Laureano in June 1992.
ولاحظت وزارة الدفاع أن التحقيقات التي أجرتها قوات اﻷمن والقوات المسلحة في كانون اﻷول/ ديسمبر ١٩٩٢ أكدت أن أعضاء قاعدة أمبار العسكرية قد اعتقلوا آنا روزاريو سيليس لاوريانو في حزيران/يونيه ١٩٩٢.

In the circumstances of the case, the Committee finds that Ana R. Celis Laureano's right to life, enshrined in article 6 of the Covenant, read together with article 2, paragraph 1, has not been effectively protected by the State party.
وترى اللجنة في ظروف هذه القضية أن حق آنا روزاريو سيليس لاوريانو في الحياة، وهو حق مكرس في المادة ٦ من العهد مقرونة بالفقرة ١ من المادة ٢، لم يلق حماية فعالة من الدولة الطرف.
