(c) This recommendation does not affect a right in immovable property that under law other than this law is transferable separately from a receivable, negotiable instrument or other obligation that it may secure;

The law should provide that a security right in movable property that is subject to registration in a specialized registry or notation on a title certificate under law other than this law may be made effective against third parties by registration as provided in recommendation 33 or by:
39- ينبغي أن ينص القانون على أنّ الحق الضماني في الممتلكات المنقولة الخاضع للتسجيل في سجل متخصّص أو للتأشير بشأنه على شهادة ملكية بموجب قانون غير هذا القانون يجوز جعله نافذا تجاه الأطراف الثالثة بواسطة التسجيل حسبما هو منصوص عليه في التوصية 33، أو بواسطة ما يلي:

The law should provide that a security right in an attachment to movable property that is subject to registration in a specialized registry or notation on a title certificate under law other than this law may be made effective against third parties automatically as provided in recommendation 42 or by:
43- ينبغي أن ينص القانون على أن الحق الضماني في ملحق لممتلكات منقولة خاضعة للتسجيل في سجل متخصص أو للتأشير بشأنها على شهادة ملكية بموجب قانون غير هذا القانون يجوز جعله نافذا تجاه الأطراف الثالثة تلقائيا على النحو المنصوص عليه في التوصية 42 أو بواسطة ما يلي:

If law other than this law provides that a supplier of goods has the right to reclaim the goods, the law should provide that the reclamation right is subordinate to a security right that was made effective against third parties before the supplier exercised its reclamation right.
92- إذا نص قانون غير هذا القانون على أن لمورّد البضائع حق استردادها فينبغي أن ينص القانون على أن يكون الحق في الاسترداد أدنى مرتبةً من الحق الضماني الذي جُعل نافذا تجاه الأطراف الثالثة قبل أن يمارس المورِّد حقه في الاسترداد.

(b) Any rights of set-off that the depositary bank may have under law other than this law are not impaired by reason of any security right that the depositary bank may have in a right to payment of funds credited to a bank account.
(ب) أنّ أي حقوق في المقاصة قد تكون، بموجب قانون غير هذا القانون، للمصرف الوديع لا تُمّس بسبب أي حق ضماني قد يكون للمصرف الوديع في حق الحصول على سداد الأموال المودعة في حساب مصرفي.

The law should provide that any right of the depositary bank, existing under law other than this law, to set off obligations owed to the depositary bank by the grantor against the grantor's right to payment of funds credited to a bank account has priority as against the security right of any secured creditor other than a secured creditor that has acquired control by becoming the account holder.
102- ينبغي أن ينص القانون على أن أي حق للمصرف الوديع، قائم بمقتضى قانون غير هذا القانون، في أن يقوم بمقاصة الالتزامات المستحقة له على المانح من حق المانح في الحصول على سداد الأموال المودعة في حساب مصرفي، تكون له أولوية على الحق الضماني لأي دائن مضمون غير الدائن المضمون الذي حصل على السيطرة بأن أصبح صاحب الحساب.

(h) To the extent that the automatic effects under subparagraph (a) of this recommendation and recommendation 49 are not impaired, this recommendation does not affect any requirement under law other than this law relating to the form or registration of the creation of a security right in any asset, securing payment or other performance of a receivable, negotiable instrument or other obligation, that is not covered by this law.
(ح) بقدر ما لا يكون هناك إخلال بالآثار التلقائية المترتبة بمقتضى الفقرة الفرعية (أ) من هذه التوصية وبمقتضى التوصية 49، لا تمس هذه التوصية أي اشتراط يقتضيه قانون غير هذا القانون ويتصل بشكل أو تسجيل إنشاء حق ضماني في أي موجودات، يضمن سداد مستحق أو صك قابل للتداول أو التزام آخر، لا يتناوله هذا القانون، أو أداءه على نحو آخر.

If law other than this law gives rights equivalent to security rights to a creditor that has provided services with respect to an encumbered asset (e.g. by repairing, storing or transporting it), such rights are limited to the assets in the possession of that creditor up to the reasonable value of the services rendered and have priority as against pre-existing security rights in the asset.
91- إذا كان قانون غير هذا القانون يعطي الدائن الذي قدم خدمات تتعلق بموجود مضمون (بإصلاحه أو تخزينه أو نقله مثلا) حقوقا معادلة للحقوق الضمانية، فإنّ تلك الحقوق تقتصر على الموجودات التي في حوزة ذلك الدائن، في حدود القيمة المعقولة للخدمات المقدمة، وتكون لتلك الحقوق أولوية على الحقوق الضمانية القائمة من قبل في الموجود.

The law should provide that, notwithstanding recommendation 90, an acquisition security right that is made effective against third parties within the period provided in recommendation 189, subparagraph (b), has priority as against the rights of an unsecured creditor that, before the security right was made effective against third parties, under law other than this law:
