Under the Maintenance of Children's Act Cap 44:00 of the Laws of the Gambia, the parent of a child is bound to maintain his child whether legitimate or illegitimate.

Count 1: importation of rough and uncut diamonds without a licence contrary to S. 172(a) of the Customs Act, Cap. 86:01, Vol. VIII, Laws of the Gambia.

However, those rights are not absolute; they are to be exercised subject to respect for the rights and freedoms of others and to other Laws of the Gambia promulgated in the interest of the sovereignty and integrity of the country, including national security, public order, decency and morality.

I also served as the Desk Officer/Legal Adviser for certain institutions such as Women's Bureau Desk and my responsibilities here included the giving of legal advice on gender issues, interpretation and analyzing of International Conventions such as the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), the 1997 Constitution and other Laws of the Gambia and also any other legal matter that may arise.

As the accused was found in possession of prohibited goods, not to have imported them, without a licence, S. 65 of the Minerals Act, Cap. 64, Vol. VII, Laws of the Gambia, states that " any person who being in possession of any mineral does not prove to the satisfaction of the court that he obtained such material lawfully shall independently of any other liability be guilty of an offence " .
وحيث إن المتهم قد وجدت بحوزته سلع محظورة لا تستورد إلا بترخيص، تنص المادة 65 من قانون المعادن، الفصل 64، المجلد السابع، من قوانين غامبيا على أن " كل مـَـن يوجد بحوزته أي معدن لا يـُـثبت بما يرضي المحكمة أنه قد حصل عليه بصورة مشروعة، يـُـدان بارتكاب جنحة، بغض النظر عن أي مسؤولية قانونية أخرى " .

From all the above, I find neither of the accused guilty of importation of rough or uncut diamonds into the Gambia without a licence contrary to Section 172(a) of the Customs Act, Cap 86:01, but I find the 1st accused guilty with respect to S. 65 the Mineral Act, Cap 64:01, Vol. VII, Laws of the Gambia, for being in possession of a mineral without a licence.
مما سلف، لا أجد أن أيا من المتهمين مدان باستيراد الماس الخام أو غير المصقول إلى غامبيا بدون ترخيص بما يتناقض مع المادة 172 (ألف) من قانون الجمارك، الفصل 01:86، ولكني أجد المتهم الأول مدانا بمقتضى المادة 65 من قانون المعادن، الفصل 01:64، المجلد السابع من قوانين غامبيا باحتيازه معدن دون ترخيص.
