By their nature, these types of documents contain commercially sensitive information; their disclosure to competing suppliers or contractors or to an unauthorized person could impede fair competition and would prejudice the legitimate commercial interests of the suppliers or contractors.

)أ( المعلومات التي ينطوي افشاؤها على مخالفة للقانون أو تعويق ﻹنفاذ القانون أو يكون متعارضا مع الصالح العام أو ضارا بالمصالح التجارية المشروعة لﻷطراف أو حائلا دون المنافسة العادلة؛

(a) information if its disclosure would be contrary to law, would impede law enforcement, would not be in the public interest, would prejudice legitimate commercial interests of the parties or would inhibit fair competition;
)أ( المعلومات التي ينطوي افشاؤها على مخالفة للقانون أو تعويق لانفاذ القانون أو يكون متعارضا مع الصالح العام أو ضارا بالمصالح التجارية المشروعة لﻷطراف أو حائلا دون المنافسة العادلة؛

Paragraph (1) also encompasses information whose disclosure would be contrary to law, would impede law enforcement or fair competition or would prejudice the legitimate commercial interests of the suppliers or contractors.
3- وتشمل الفقرة (1) أيضاً المعلومات التي يكون في إفشائها ما يخالف القانون أو ما يعيق إنفاذَ القانون أو التنافسَ العادل أو ما يلحق الضرر بالمصالح التجارية المشروعة للمورِّدين أو المقاولين.

(a) Information from the record of the procurement proceedings if its non-disclosure is necessary for the protection of essential security interests of the State or if its disclosure would be contrary to law, would impede law enforcement, would prejudice the legitimate commercial interests of the suppliers or contractors or would impede fair competition;
(أ) معلوماتٍ من سجل إجراءات الاشتراء، إذا كان عدمُ إفشائها ضرورياً لحماية المصالح الأمنية الرئيسية للدولة أو إذا كان إفشاؤها يخالف القانون أو يحول دون إنفاذ القانون أو يُلحق الضررَ بالمصالح التجارية المشروعة للمورِّدين أو المقاولين أو يعوق التنافس المنصف؛

(6) No information under paragraphs (3) to (5) of this article shall be disclosed and no public proceedings shall take place if so doing would be against the protection of essential security interests of the State or contrary to law, would impede law enforcement, would prejudice the legitimate commercial interests of the suppliers or contractors or would impede fair competition.
(6) لا يُفشى أيّ من المعلومات المشار إليها في الفقرات (3) إلى (5) من هذه المادة، ولا تُنظَّم أيُّ إجراءات علنية إذا كان هذا يتعارض مع حماية المصالح الأمنية الأساسية للدولة أو يخالف القانون أو يعيق إنفاذ القانون أو يمس بالمصالح التجارية المشروعة للمورِّدين أو المقاولين أو يعيق التنافس المنصف.

لا تُفشَى أيُّ معلومات في سياق إجراءات الاعتراض أو الاستئناف، ولا تُعقد أيُّ جلسة استماع علنية بمقتضى المادتين 65 و66 من هذا القانون، إذا كان إفشاؤها أو عقدها يضعف حماية المصالح الأمنية الرئيسية للدولة أو يخالف القانون أو يعيق إنفاذه أو يمس بالمصالح التجارية المشروعة للمورِّدين أو المقاولين أو يعيق التنافس المنصف.

Reference in this regard was made to the provisions of article 11 (3) of the Model Law, which gave exceptions to disclosure of portions of the records of the procurement proceedings relating to detailed information on the examination, evaluation and comparison of submissions, as well as disclosure of records if such disclosure would inter alia inhibit fair competition or would prejudice legitimate commercial interests.
وأشير في هذا الصدد إلى أحكام المادة 11 (3) من القانون النموذجي، التي تنص على استثناءات من إفشاء الأجزاء من سجلات إجراءات الاشتراء التي تتعلق بالمعلومات التفصيلية عن فحص العطاءات المقدّمة وتقييمها والمقارنة بينها، وكذلك إفشاء السجلات إذا كان من شأن ذلك الإفشاء، في جملة أمور، أن يحول دون المنافسة العادلة أو أن يضر بالمصالح التجارية المشروعة.

(b) The contract price or, where necessary, a summary of other characteristics and relative advantages of the successful tender or submission, provided that the procuring entity shall not disclose any information if its disclosure would be contrary to law, would impede law enforcement, would not be in the public interest, would prejudice the legitimate commercial interests of the suppliers or contractors or would impede fair competition;
(ب) قيمة العقد، أو، عند الاقتضاء، ملخصا لسمات العطاء أو العرض الفائز الآخر ومزاياه النسبية، شريطة ألا تفشي الجهة المشترية أي معلومات، إذا كان إفشاؤها مخالفا للقانون أو يحول دون إنفاذ القانون أو لا يخدم المصلحة العامة أو يلحق الضرر بالمصالح التجارية المشروعة للمورّدين أو المقاولين أو يعوق التنافس المنصف؛

The 1994 exception referring to legitimate commercial interests of the parties has been replaced with a reference to legitimate commercial interests of the suppliers or contractors.
واستُعيض عن استثناء عام 1994 الذي يشير إلى المصالح التجارية المشروعة للأطراف بإشارة إلى المصالح التجارية المشروعة للمورِّدين أو المقاولين.

That latter requirement was considered to be especially important for preventing collusion, protecting legitimate commercial interests of the bidders and thus maintaining competitiveness in the market and ensuring the success of future auctions.
واعتبر ذلك الشرط الأخير هاما بوجه خاص لمنع التواطؤ وحماية المصالح التجارية المشروعة لمقدّمي العطاءات وبالتالي المحافظة على التنافس في السوق وضمان نجاح المناقصات المقبلة.
